i would say your mum is responsible
responsible for checking the lid was on correctly and also for putting it in her handbag.
stain remover is toxic and therefore should be kept seprate in a plastic carrier bag which the store would/should have provided.

the store didn't provide a plastic carrier bag, they only use paper bags. my mum was using a bag for life type bag, meant to cut down on the use of carrier bags. the stain remover is bio-degradeable and not toxic.

  • I'd say it was the customers responsibility to check the lid was secure before placing in bag. Sorry about that.

    very shocked at the replies.

sainsburys didn't say it was my responsibility to check the lid was on the fabric conditioner before i put it in my trolley.

i know that tesco will pay out for a car to be valeted if a bottle of milk spills in your boot due to lid not being on properly. i also know that either focus or b&q paid for replacement carpets in a car when a tin of paint was spilt, again due to lid not being on properly.

i don't see how putting an item in a bag is any different.

the people in the shop apologised to my mum when she went straight back in with her leaking bag, why would they apologise if they didn't think it was their fault? the lid should have been on the bottle properly in the shop.

£100 is a lot of money to my mum, she doesn't work, she is a housewife. the mobile was a present from my dad. she doesn't really have the money to buy a new one.
  • I think a lot of places work on the basis that if it happens in the shop then they will compensate you, once you take the goods out of the shop they are yours so it your responsibility to look after them properly (ie, don't put liquids in a bag with electricals).

Some places will be more generous than others - did your mum actually speak to a manager or just a shop-girl? Might be worth writing a letter of complaint, won't hurt.

home insurance normally covers belongings in handabags. not all will cover mobile phones though. worth checking if you get no joy from the shop.
