Hi All
I was wondering if anyone knows the address for the halifax/Bank of Scotland to claim through financial hardship? Do you have to ask them for a form or what is the process?

These addresses are where you need to write to in order to request your bank statements. You might need Roberto1982's address below if your claim is already underway though.

Just use the templates from martins guide.
I filed under hardship to Halifax, asked for £2500 to settle quickly(total cahrges were 3020 inc. interest) Got a letter back today last weekend offering £133 plus no charges for 3 months.
Rang the number today to see if they would budge and surprisingly they said..........NO! advised me that until court case was resolved, this offer was non negotiable. :mad: So i've rang FOS today to set wheels in motion with them they advised the process could take 6 months!! has anyone else had success using this method vs. Halifax and if so how long did it take???
Finally, does anyone atually know what is happening with the court case is it going to get sorted out on the 22nd June or will it just get put back again??

The court case with the House of Lords is starting June 23rd(it was moved 1 day about 6 weeks ago).
I would suggest negotiation based on priority debt arrears(mortgage/rent, council tax, utilities) and the amount offered, ie if they offered £133 and it doesn't cover arrears then try to argue that the amount does not cover those arrears. Perhaps you could ask them which you should pay first as each one are equally as important in your eyes and you aren't sure who you should prioritise first.0 -

I'm not on a DMP, I approached CCCS who produced an Income and Expenditure report for me which showed I had a negative disposable income. I sent this report to both Natwest and Barclays with my claim for charges. Natwest responded with arequest that I complete their Financial Hardship form Barclays acknowledged my complaint. Yesterday received a letter from Barclays telling me that they had paid just under £1500 into my current account against the £1900 of charges claimed, as a gesture of goodwill. Their letter says however that. "In the event that we are ordered by a court or regulatory body or otherwise to make any payment in respect of your complaint, such payment will be made net of the gesture of goodwill payment we are now making"
In other words they are not trying to use a full and final settlement get out
I hope this result gives others in a similar situation to mine some hope.

if the firm attempts to resolve a relevant charges complaint after 27 July 2007:
(a)
the firm must not seek agreement from the complainant that the resolution is in full and final settlement of the matter;
(b)
in relation to such complaints, if the outcome of the test case produces a result that is more favourable to the complainant, the firm must take all reasonable steps to pay any difference in the amount of compensation actually received by the complainant and that that the complainant would have been entitled if his claim has not been settled by the firm then; and
(c)

Give them enough time to have received the form and chase them up, even if you have to repeat about how difficult it is with priority debt arrears0 -
Well i am claiming under financial hardship with Natwest sent off the I&E forms with a little letter explaining my situation (recorded delivery) and within 4 days of it arriving at Natwest i recieved a letter stating i had been accepted, which is good news so far. This letter explained i will recieve an offer soon. So i let a week pass and no reply i phoned the direct number they gave me and was told that they have computer problems at the claims department
and that it proberly will not be sorted until 3/6/09 so i think there could be a bit of a back log going on. So once i recieve my offer i will update how i get on. My claim was for £3000 so we shall see :cool:
