hi i have had a decision from the financial ombudsman adjudicator they went in favour of the bank and agreed that £15 and 3 months worth of suspended charges was fine even though i have well over £2000 in charges it has been going on since jan 2009 and have spent about £200 in phone calls between them and the bank (hbos) the worst bank ever i have also been a loyal customer with them for over 12 yrs even my kids have accounts with them so am now taking it to an actual ombudsman now and see what happens and also i have been proven to be in financial hardship0

Do you have any priority debt arrears(mortgage/rent, council tax, utilities)?

The ombudsman hasn't adjudicated in favour of the bank since they have offered £15 and no charges for 3 months even if items are returned unpaid. Remember the bank do not have to refund even 1p under the FSA waiver plus it will have cost the bank £500 for the complaint(so you have cost em some money). The offer is not full and final which means on the conclusion of the OFT test case issues you can still reclaim the rest. I would say from one perspective that you have had a result of sorts.

I claimed financial hardship to HSBC recently. I first claimed charges refund in July 07 then got made redundant in August 08 (hence hardship claim).
I filled out and returned a budget form that they recently sent me, I got a letter in the post today saying I should give them a call to discuss my hardship but that MY CLAIM WILL REMAIN ON HOLD UNTIL THE COURT CASE HAS CONCLUDED.
Has anyone had a similar response? Has anyone got any advice?0 -

Banks often bluff/waste time/pretend they don't know laid-down procedures in the hope you'll go away - they should've used your forms to assess your hardship claim and given you an answer (assume they didn't eg. say agreed/not you're in hardship - if they don't agree, phone up ombudsman and get advice). Phone up as they suggest, but make notes of call and write a letter (send recorded) confirming what was said/agreed (get a name/dept.) - letters are your only proof, not phone calls (but sometimes you can cut a good deal). Note what the ombudsman says also: you can quote that in letters (if in your support) - I used that as confirmation that I was in hardship (Barclays said "couldn't tell") and Barclays eventually paid up after saying they wouldn't, although only about 30% - back to ombudsman for me.
Advice: 1. learn the system 2. persevere (be polite but bloody minded)0 -
its now 11weeks since i claimed financial hardship with halifax. Phoned the other day and was told i had to go through money managment and give them details of incomings and outgoings. I done this and am now waiting to hear back. They keep saying they have sent me letters keeping me updated (which i never seem to recieve!) and dont know where i should go from here???anyone had any luck with halifax recently?currently unemployed and my outgoings are way higher than my incomings!!!also have a daughter to provide for and im a single parent. I fit every category 4 financial hardship and seem to be getting nowhere!any advice would be greatly appreciated folks0

Claiming £2854 from Nationwide. Have now sent 4 copies of the Incoming and Outgoings form. One of them was faxed from my local branch (at their request) and they say that they have not received any of my forms!!!! Has anyone else had this problem with Nationwide??0

I called Barclays today and apparently my claim has been resolved. However, the very helpful chap on the phone said that unfortunately he could not tell me the result of my claim as it had not yet been signed off but that I should receive the letter in couple of working days. So fingers crossed I should know by Tuesday and hopefully it will be a positive result in my favour....0

I rang Barclays in April requesting a copy of my Bank Charges and was sent a budget planner on 3rd May asking to complete. So, I completed it and sent it back then got a letter on 13th May saying I would have a decision within 10 working today, which is today.
I have been calling every other day to make a pain of myself and keep them on their toes, and today is 10th day, so I called this morning and was told there was no update, so I called back at 17.00 tonight and was told someone was actually looking at my claim as we spoke and would be calling me within 5 minutes.
An hour later and no call, so I just called them back and was told a letter was on its way to me with my bank charges (which was requested 7 weeks ago!) but still no decision.
So, I asked to speak to a manger who told me that due to the fact that they are inundated with claims on financial hardship they now have a huge back log and need more time to assess them all.
So I asked what the timeframe was now for an answer and was told they cant give me one as they have just said in the letter 'asap'. I said I wasnt happy to be told I would get a reply today and then not get one, but she said there is nothing I can do to speed it up and would just need to be patient!!!!
Its not looking good....has anyone else had problems with getting an answer from Barclays and what can I do now???

I'd say to keep calling them. I started my claim at the beginning of May 2009 and once I had sent my budget planner back and received a letter confirming receipt of the BP, I then was just calling them every other day, pestering them politely, requesting an update on the status of my hardship claim.
And when I phoned this Wednesday just gone, the very nice lady that I spoke to apologised profusely for me having to wait so long (!) and said she would immediately fax the team dealing with my complaint straight after she had finished talking with me.
And lo and behold, when I phoned today (2 days later), I was told that my case had been resolved yesterday, was waiting to be signed off and that I should receive a letter within the next couple of working days, so don't give up, it will happen. I just hope my complaint outcome is positive in my favour.....
