    I would negotiate on the basis that while £2000 will clear x debt and y debt, it still leave z debt and therefore you would still need a further £1500 to be up to date on the priority debts. Might be worth asking them who they think is more worthy of getting the £2000 cos you believe all are equally worth catching up on.

    Having read most of the posts on here it seems that Lloyd's are the only one's playing real hardball. I have submitted my claim and have had the usual reply (Standard letter) saying I am not in hardship and they will only look at claims after the Test case on 22nd June. Funny this as
    I am on long term sick with a heart condition and my income has dropped from £2200 a month plus £112 Tax credits to £93.00 a week plus £112 Tax credits. Lloyd's called me and I went trough an income and outgoings and we discussed the latest charges. I was just over £2.00 overdrawn for 5 days and they charged me £39.00. I explained that I could get money cheaper from a door stop lender and that to my calculation's it was about 1500% APR. The lady on the phone contracted a stammer and agreed to wave the charge:T. then agreed that I was in hardship due to not fault of my own. Well the battle goes on!!!! To all people claiming charges good luck and keep fighting it is worth it in the end. A big THANK YOU to Martin:money:I would never have started this.. Thanks Mate

Its called the Social Security administration act 1992 (chapter 5)! It basically means in simple terms if you have £90 benefit going into your accout no matter what the status is, the bank are not allowed to take their charges! So I called the A&L and within mins some of the charges were credited back to my account! They are also reviewing the other charges I am in the process of claiming back! I will be contacting the Clydesdale too........ as they also have been extracting their charges over the last few years. Just something to bare in mind for those people struggling on benefits and being robbed blind and put further into debt by greedy banks. So get to the Job Cetre Plus Office and ask for a copy of SOCIAL SECURITY ADMINSTRATION ACT 1992 (.5) 1992 CHAPTER 5

    SSAA 1992 with regards to charges are about assignment of debt.

    Section 187. Bank charges are not charges as assigned in the Social Security Administration Act. Once the benefit hits the account it is treated as income. Bank charges are unfortunately not assignments for debt.

  • Hi, I just wondered if you could tell me what and I&E form is....sorry if this is a stupid question.

    I have just been charged an emense amount and been sent a defult notice by Natwest because of a failed DD, before they even notifyed me of the DD!! I wrote to them claiming that they hadn't acted fairly and that I was now met the fsa's definition of financial hardship (recently unemployed and pregnant) - they wrote back answering none of my queries, saying that their charges are fair and that I should contact the citerzens advice beaurea!!

    What am I doing wrong?! They have threatened to close my account within 28 days of the original letter (2/5) but no mention to this at all in their reply.....Im stuck and paniced!! Help x x

    Have you started the process of reclaiming ALL your bank charges? What stage are you at?

    Income and expenditure - you are normally asked to fill one in to prove your outgoings are more than your income to cover them.

    see previous replies I've posted (follow bank's complaints procedures, do all recorded letters, phone FOS for guidance, take to them if exhausted bank procedures, etc). Also recommend if things are spiralling, to contact reputable debt advice agency eg. CCCS; you can go on debt management plan, the principle of which is for you to manage first, pay debts off second (ie they're NOT the priority so long as you pay something regularly).
    Also recommend open new bank account (Alliance and Leicester still doing £100 giveway - must be doing good trade), transfer all in/outs and close old account. Then your interest will be frozen (and further charges stop of course) as is passed onto a debt collector; however if you have a complaint in the pipeline the bank can't demand you settle your account - good one!

    would I be right in thinking, if an account was closed and monies owed passed to a debt collecting agency, this then would be a debt therefore that would then apply?
