    I am claiming bank charges from Halifax via the Financial Hardship ruling and today have been offered £2000 - my actual claim is for £5686 and with charges £8478.11. I am being offered a payout only on part of the claim. I would like to come to a more substantial settlement figure but am also frightened of jeopardising my initial offer - any suggestions? :confused: Do I take the offer, and contact FOS regarding the rest do I refuse the offer and go to FOS

    Quick question.

    Im owed about £400 (thats without interest) worth of charges from NatWest. They put me on a managed overdraft which I couldnt afford and defaulted after 2 payments - Im now on a DMP with Kensington and this debt is part of the payment plan.
    They seem to be ok with this but Im still getting charged. Can I claim hardship due to being on a DMP or doesnt it work like that???

    i cliamed financial hardship with the halifax 10 weeks ago. Phoned them this morning to see if any outcome yet and they sated they had wrote to me on 27th April (which they didnt!!) and also stated they contacted Brunel and franklin (the company dealing with my bank charges cliam) however they never contcted them either!! Are they just trying to put it off? Contacted Brunel and franklin this afternoon and didnt know where to go from here. I know i can complain to the financial ombudsman now but would rather have a definite answer from the bank. anyone else in this situation?my debt is getting worse and constantly having letters through the door HELP!!!:confused: have also lost my job and fit into every category to beable to claim financial hardship

    Sadly that was an objective comment based on it happening frequently to me - that is, the initial bank response is often clearly designed to frighten off a prospective claim (usually interprets as "no chance" - it worked the first time for me, left it nearly a year until I came back on this site) and gives wrong information (Halifax actually stated the true cost of my going over the limit was the £35 charged, for eg.; Barclays stated would definitely NOT refund charges in connection with my hardship claim (suggested this was a ploy on my part, picked up through the media eg. this site?)), which subsequently is frequently turned around (they refunded! - and in my experience too, that is insurance company tactics). I'm also escalating a complaint with Barclays due to the "complaint handler" blatantly lying (in his letters - low IQ or what?) and then finally putting a hold on my statements being sent out (yes that's true!).
    Reading how miserable it makes other people who haven't got used to the tactics does make one more to the point don't you think?!
    Interested on figures on FOS lack of effect - had been led to believe otherwise - oh dear....
    Didn't quite get the last bit - did you mean someone was actually charged costs for trying to lift their stay due to hardship, by the court?

    I kinda know the enemy from the other side of the counter so to speak. I think, for me, understanding the enemy and how they are looking at hardship is the way I am tackling things based on what others are reporting and on reports across other forums.
    Someone lost hardship lift and had costs awarded against them. I don't want to comment too much on their case cos I did see the paperwork and it was obvious why.

    Any settlement figure is not a full and final settlement of your claim. I would look at arrears against amount offered and accept and negotiate a higher amount.

  • i o]put in a claim for bank charges approx 2 yrs go with a company called financialclaims.co.uk. i have sent them a hardship form and tried to contact on a number of occassions but with no success.
    i would rather put the claim in myself as it has been over 12 months since last hearing from them, but am worried that i am legally bound to them now processing the claim for me. Has anyone else used this company to reclaim charges?

    hi wooooodzy i to am going throw halifax it took me 8 weeks from start to finish i kept phoning them and today they have gave me conformation that i have been accepted and will recieve an offer this week the best advice i can give is keep phoning them i was on the phone to them 3 days aweek they will soon get fed up of you and deal with your case

    Many Thanks for your help - I called the Halifax today to see if I could negotiate over the phone but the person I was speaking to just told me this was a goodwill gesture and there was nothing further she could or would do - this only covered the period March-May of this year - do I accept take this off my original total and then resubmit another claim?

    How much is your priority debt arrears?

    EDIT: any payout is not in full and final settlement of your claim.
