I have applied to Halifax on financial hardship and they are willing to pay out 1/3 of claim £183 but want to pay into my current account which is subject to a repayment plan and is overdrawn. The credit to this account would be of no financial gain to me and I would still be in financial difficulty. I have written to Halifax to ask that alternative payment i.e cheque or paid into new bank account but they cannot comply. I have contcted FO to complain and seek their advise. Also written a another letter stating if the Halifax account had been closed then the funds could not be deposited into my account. Seems very unreasonable and would only be of advantage to Halifax and not for the purpose I applied?
Any suggestions/advise etc?
I would argue the case that the amount refunded does not clear your priority debt arrears and the amount is going into a heavily overdrawn account leaving nothing to clear the debts. Perhaps if they could up the amount and issue cheques to the relevant companies it would be better.0 -
I am currenlty in income support and am disabled, i am trying to claim back £6000 from llloyds TSB of bank charges under the financial hardship cluase.
As my case is on hold in the court i took my case to FOS who sent me a form to fill in regarding what i want to claim.
I told Lloyds on many times that i was suffering with a lot of debt and that they were taking money from my income support and disabilty every month but they did not resond or send me a financial statement to fill out.
I sent all the corrospndence letter to FOS and have recived this reply after 2 months.
"The FOS says the bank has looked at my complaint having reviwed my financial postion on the basis of the information about my finacial circumstances which i supplied, but however having done so it does not accept that it is under any obligation to do any more than it has at this stage.
Having considred the postion very carfully i am inclined to agree with the banks assessment.
furthemore the bank has refunded £172 a couple of months ago which i did not accept but they still put the money in there as a gesture of good will.
The FOS is basicaly saying that i operate my account wihtin the aggred over draft limit but this is not true i am allways in red and never have had been below my over draft allways over.
THE FOS have given me 2 weeks to reply and send more information i am really in the RED with debt i have £1000 to pay on Lloyds credit card which i cant afford and £600 of my loan left on top of this i have about £5000 more debt wiht other cards i am fiancially unstable and this is affecting my health really badly as i am allready disabled.
What shall i do next need some advice!!!!0 -

Do you have priority debt arrears(mortgage/rent arrears, council tax arrears, utilities)?
Do you have charges on the credit cards as well?0 -

Well no i get hosuing and council tax benefit but i do pay serivce charges which amounts to £200 a month which i cant afford to pay.
Yes my utilties bills are over due and the electric company might cut my electric if i dont pay up im just stuck !

Yes i applied to get my charges list from Lloyds credit card got a letter offering £100 pound which they will credit my account which is way off the mark i should get around £300 in credit card charges from lloyds.
What should i supply to FOS as i dont agree with them am belive i am seriously in bad fiancial circumstnaces becuse of the charges ,0 -

Are the bills late or in arrears? From what you have written it appears that I would agree with the bank. Have you set up another account with another bank yet?

Ie bank charges. The law relates to an assignment of benefits once a debt has been taken to court. It does not mean bank charges in the interpretation that you have and is a common misconception.

Accept the interim payment of £100 but state that you will be happy to persue them to court for the remaining £200(as only a court can decide the amount on credit cad charges.

Hey everyone.
I sent my Bank a letter almost two weeks ago claiming charges back due to financial hardship. I have not heard a thing off them, yet they are still continuing to charge me, one week it was for 87pence!!! the next for £1.26!!!! does this justify a £38 charge?? Any ideas on what to do if i dont get a reply from the bank?0 -

Ok , do u you know what they class as being in financial hardship for people on income support as my utilties bills are over due and i can supply them to FOS, but what about my other debt like credit cards and store cards dont they come under fincial harship.
My service charges for the property are over due i can get a letter from the council for that.
What if i get a letter from a medical profesional who look after me as they know what sittatuitiion i am in and my past medical problems which are very serious as this is all taking a lot of pressure on my health . ?0 -

Do you have a bank account with another bank?
If not you should be able to get a 'basic account' to pay any benefits into and switch any direct debits that you need to that account. I think mine took about two weeks to come through.
Go with another bank so funds can't be taken from that account to pay the other.
Re electricity bill is it actual (A) or estimate (E) readings?0 -
Hi friends,
I have a query regarding the Court Interest Calculator within the moneysaving website. I'm currently working on the claiming with interest letter under the hardship section of the site as this relates to me also.
My claim has been on hold (stayed) pending outcome of the High Court test case since August 2007 & in my claim from that period of time, my interest was calculated at 255 pounds. But when I enter my 'charge amount' that I am trying to claim back, the amount returned has calculated higher and comes out at 759 pounds of interest owed.
I understand that 2years have nearly passed since my claim & am guessing it's because of that - but am wondering if I enter the new amount into my proposed hardship letter to the bank will that be dismissed as the original amount from my claim is lower and of course documented within the legal system at that lower amount?
I'm wondering what you guys have done who are in a similar position to myself when working with your 'claiming with interest' letter and look forward to your replies.
