    hi all, been trying to get over £3000 back from natwest bank, threatened court action etc, kept sending me forms to fill in saying that as i was claiming financial hardship etc, never claimed hardship with the 1st letter but i have now relented after the 3rd letter and filled the form out, my question is, should my claim for hardship be turned down where do i stand? can i still go ahead and take them to court? 'cos that'll give me great pleasure sending in the baliffs lol.
  • I have applied to Halifax on financial hardship and they are willing to pay out 1/3 of claim £183 but want to pay into my current account which is subject to a repayment plan and is overdrawn. The credit to this account would be of no financial gain to me and I would still be in financial difficulty. I have written to Halifax to ask that alternative payment i.e cheque or paid into new bank account but they cannot comply. I have contcted FO to complain and seek their advise. Also written a another letter stating if the Halifax account had been closed then the funds could not be deposited into my account. Seems very unreasonable and would only be of advantage to Halifax and not for the purpose I applied?
    Any suggestions/advise etc?
  • Hi, just want to ask if its okay to reclaim bank charges now while Im still waiting to finalise the debt management plan Ived been having financial difficulty for nearly a year now and I did ask the help of debt management company . I want to claim bank charges because base on the guidance of FSA regarding financial hardship I can truly say that Im on that situation right now. Please be advised . Thank you

    I have a bank statement going back to 2001 with bank charges of £511.00 I also owe that bank £439.00 thay have sold the Dept to a dept collector, can I use the bank charges to offset the dept?

    Possibley a daft question but im having a blonds day and my head hurts! After winning full amount on one credit card and fitting for a better offer on the other I want to try and tackle my bank account.

    Just started to receive JSA so I know I can ask for my case to be looked at sooner rather than later. However what Im curious about is the amount I may receive from them. I have read that many people here have got as low as a 1/3 of the total amount paid out to them. If they give me an offer and I refuse it will they say im not in hardship and throw my case out?

    Im with the Halifax and attempting to claim £900 including interest btw.

    Basically u can go down the bank charges route based on financial hardship, ur only asking for ur case to be considered, (not meaning that horribly,in the nicest of ways).
    If u were lucky enough to get an offer, say 1/3rd of what u were asking for, to get around it, u accept their offer,but without prejudice, tol eave you free to reclaim the difference at a later date (ie when those above finally c sense and admit bank charges are way to high)

    I cant see how they can say these charges were reasonable, a number of them are for £68! Oh well, i'll send the letter off and see what happens :rolleyes:

    Are banks currently repaying charges? I spoke to my bank today who said that they will not pay anything until after the court case in June-July of this year. I bank with the Co-operative bank & would be interested in finding out if anyone has successfully reclaimed from them recently.

    I can only assume you spoke to either (a) Branch staff or (b) telephony staff. They don't work with the specialised team that deal with hardship claims.
