We as tax payers own Lloyds! Basically they owe the government £23bn so i wouldn't expect them to pay out without a fight.
I've had the usual rubbish from them also. I've since replied referring to specific sections of the new waiver and again asking them to address my complaint, adding that if they dont i will forward the claim to the FOS including all correspondance and statements proving the charges were directly responsible for the difficulties with my accounts.LBM - :beer:

DFD - July 2017 = £0

well to me it seems the banks are just ignoring the fsa guidelines for financial hardship as i havnt seen many success stories with it,i hope this is not the case,ive applied uder these guidlines for £3700 worth of charges but im not confident,ill probably get the same responce,""do not qualify"",the banks are hiding behind this,if this goes on any longer i think the banks will be more damaged by there constant head in the sand attitude,i rang the halifax to see how my finacial hardship case was coming along and got a young lad who just waffled on and said no no no no no to every attempt at getting a resolution,the banks know they have lost this case but do not want to admit it or start paying people there money,they are horrible greedy people and one day i know we will see justice,:beer:missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter0

Did you ring the team that deal with hardship or their central telephony centre? The banks have not lost the case whilst it is still under appeal. At the moment, they won the argument that bank charges are no penalties in law. However they lost whether they were assessable under UTCCR 1998. No terms so far have been legally tested in court over fairness, ie the specific term itself. There is a successes thread here on MSE which shows some of the success some people are having but there are threads on the main part of the forum where wins are being shown. Don't give up on getting paid out but there is nothing in the waiver that says the bank HAVE to pay out under Financial Hardship.0 -

was claiming with lloyds sent them proof of financial hardship (copy of my reposession order) and they still put my case on hold and refuse to deal

Just had a call from Yorkshire bank, unfortunately I don't qualify as a financial hardship case. I contacted the Ombudsman several weeks ago and think that is why I finally got a call, but it was bad news unfortunately. I was told that I'd have to wait until the end of the test case.
Any ideas where I could go from here? Is it likely that the Ombudsman could get Yorkshire bank to overturn this decision? I think things are looking pretty bleak. I just wish I had put my claim in 6 months earlier, i'd have been paid out ages ago.0
