    well ,no joy with the halifax,after being told on the phone that i DO qualify for financial hardship by mr nick gibbs(customer relations manager),i rang today and was told now that i do not qualify and they would give me £70 as a good will gesture,im owed £4000.00 in charges,i explained everything to him but the deaf ears and walls were again put up,im getting really sick of these condescending muppets who work for the halifax,bunch of paid barking dogs for the banks,all they are doing is blocking attempts to get back what they owe us,this country and its ways of treating customers and its people makes me want to throw up,i notice how they didnt send me a letter saying that i did qualify,just one that said i didnt,conned again by the halifax,i wish they had gone bust and then they would see what having no money is actually like,conned conned conned:mad:
    missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter

    If they had gone bust they wouldn't have offered you £70 so calm down. First of all does the £70 cover priority debt arrears(mortgage/rent, council, utilities,)?
    If not then negotiate on the basis of arrears and NOT on the total of the claim since their offer is not a Full and Final Offer.

  • Hi, a little about my situation, first claimed late july 07 and received a letter about everything on hold so thought there was no chance of seeing any money. Was told about the financial hardship case by my sister and to visit this site, claiming hardship due to being on benefits and over £500 in charges in the last year, sent off templates and breakdown of my charges, received the budget planner but was stuck. Wanting to explain my situation fully i told them about my cheating lying ex that left me and his two babies with rent arrears resulting in a CCJ and water rates that i have to pay back at £76 a month because it had apparently not been paid for over a year. I dont receive any financial help for the debts he left or our kids, we dont go on holidays or day trips, i tried to go back to work and ended up worse off than on benefits and everything is now causing me to take medication for sleepless nights and depression. I got another planner sent as they hadnt received the first one and decided to write it all out again and just put that he had left me in debt as i didnt want to sound like i was putting it on and be rejected when they read it. Now reading all the sucsess stories in the other thread about them claiming there was no food on the table or holes in their shoes i really think i should have sent the original planner.
    I just want what is owed to me so life can be a little easier for the three of us and we can get on with our lives but i just dont know how this is going to turn out. im not asking for sympathy i just dont know if i did the right thing.
    I do want to say congratulations to everyone that has got their charges back and hopefully i can put my sucsess story on that board!!!

    RBS have agreed to pay out £738 this was agreed last week the account is overdrawn by £300.00 they have said they will pay it into the account. but yestederday and today they have added another £325 in charges which now total £625.00 so now when this money goes into my account i will only get £103.00

    yes i am annoyed and need to calm it a bit,the annoying thing is this,

    1.outgoings exceed incoming money each month.
    2.£4000+ worth of charges in the 6 years
    3.rearanged debts and plans constantly with debtors(concil tax etc)
    4.still being charged £35.00 a time always missing payments d debits as not enough coming in)
    5.i meet the requirements of financial hardship and am still refused by the halifax and mr nicholas gibbs(customer services manager)
    6.been told there final offer is £70.00 until court case is over.:mad:

    3.rearanged debts and plans constantly with debtors(concil tax etc) Are you still doing this? This may not go in your favour on Financial hardship even though it sounds perverse as I write this. Are there any charges levied by the companies for late payments?
    4.still being charged £35.00 a time always missing payments d debits as not enough coming in) I would cancel non essential Direct Debits and pay them in cash.
    5.i meet the requirements of financial hardship and am still refused by the halifax and mr nicholas gibbs(customer services manager) He is doing the job Halifax hire him for with their criteria. It doesn't mean he agrees with it personally(not that I know him or his opinions).

    It doesn't answer the question I asked. Does the £70 cover the priority debt arrears? If the answer is no then negotiate the amount based solely on that principal, ie my priority debt arrears are £200 for example, and you have offered me £70 out of a possible x amount. Can you up it to cover the priority debt arrears? If they still say no, then ask the FOS to have a look at it based on the criteria that I have set out.

    Are the charges they have refunded part of that amount? If not then you have a new claim for the additional charges.

    a&l admitted we were in financial difficulties in oct 2008,and although in a letter fom them stating we were a harship case nothing happened. We contacted the ombubsman who took over our case.we sent the letter from A&L confirming this to the ombudsman and after numerous calls to them the same story comes back from them, we are waiting for A&L to reply.in jan this year i had on operation and have not worked since, i recieve no benifits because im self employed and my buisness has made a loss in its first 2 yrs and could not pay my national insurance contributions, although i have paid class1 for 29 yrs.
    my partner had a spinal operation in the same month, then another op to remove a blood clot, then contracted MRSA. she has been off work since.
    We have a total income of £594 a month. our mortgage is £658 without all other bills i think anyone could work out we can not afford to live.we have no savings or anyone to help us financially. this is not a sob story ,this is fact. can some one please tell me what is defined as a HARDSHIP CASE

    I have just received my third financial statement to complete from HBOS can I be right in thinking this is a stalling tactic? They have asked me to complete the form again as they can not see any clear signs of financial dificulties with them or others. I sent a letter from my mortgage provider stating I was in arrears and the financial statement could not have been clearer, it shows the difficulty I am in, and all they keep doing is sending me the form to complete over and over again. Feels like I'm hitting my head against brick wall. Do I go to the ombudsman now?? Please help!!!
