    Hi all,

    I was just wondering in everyones experience is is better to send off the income/expenditure form with your firsl claim letter?

    I am just waiting for my bank statements to come through from barclays so going to prepare my claim letter/areas forms etc.

    With barclays should I just wait for them to send me their official form or is there a template one I could use?

    hi, another newbie here,

    Obviously ive been reading through the thread but no-one here has had this happen as far i can see...

    I come to a point in the process that ive asked for a refund on my charges under hardship with barclays including interest and have had a envelope with a letter saying they have acknowledged my claim and it is being processed and have an outcome as soon as possible. But generally go to say that it wont be till after test case etc.

    Now a decision as soon as possible has come to new levels... in the same envelope! Another two pages to say that they wont be processing my claim under their new account rules, ie - personal reserve and that. Both letters were processed by the same person on the same day!

    So am i right in saying i write to obudsman?? please correct me if im wrong, that is why im here! Also, it mentioned i have been charged under the personal reserve... i never opted for it and never had it!

    The way i see it, i have been generally declined for something i never had. There is a contradiction!

    Have you got priority debt arrears(mortgage/rent, utilities, council tax)?

    Well they havent said they dont think im in hardship...

    Im in one month arrears with mortgage, though lucky enough to rent my place and move in at mothers, though back on full mortgage payments again. I lost my job last year and im on JSA, i have some old ultlity bills outstanding and still have my old debts to pay.

    I have to admit the pressure is off as far as my mortgage payments go and am far from flush with money.. i still have very little to live on. I sent a redundancy letter, a JSA letter and a breakdown of charges with my letter asking for charges back.
    Im claiming around 1,500inc interest since march 2003.

    you have every right to claim from the ombudsman after 8 weeks from your initial request. Judging on what you have posted the bank will not pay out on hardship and the FOS will agree. However, Barclays have been paying out so you might be one of the lucky ones.

    That post comes across really really bad. It reads as I will lie to the bank so that they pay out. Not saying that is what you are saying but how it came across.

    Personally, if someone claims hardship when they are not in hardship then it makes it worse for those in genuine hardship, ie those with arrears on a house they live in with the threat of court action almost at their doorstep. With arrears on utilities, council tax and with no money to eat or forced to eat every other day(yes I have seen that). For people not in severe financial hardship claiming financial hardship, it means that that case is looked at later and later by the banks and exacerbates their hardship. As I said, the post read differently to maybe its intention but it leaves something in the air for me so thought I would get it off my chest.

    well of course i know there are people that in trouble...and i truely sympathise with them. i took action early so i wouldnt get into trouble with my mortgage, which i hate to say, alot of people dont, or leave it too late.
    Im not lying to the bank, because that is where i am. I hope the bank does choose people in a worse state before me... Ive seen people in better situations than me post success in hardship so why shouldnt i try?
    I didnt write the last post to take the p**s, i just want and need my money back!
