rang the halifax bank yesterday to ask for my charges back yet again,explained that id applied for them as i am in fanancial hardship,have sent letters bills demands for money etc etc and spoke to nasty nick there customer relations manager who told me they would offer me £70.00 as good will gesture although i am owed £3.750,obviously i told him to shove it,he admitted to me that i am in financial hardship but the policies state they cannot refund my charges.
he also said if i wanted to take it further i should go to the f.o.s and let them sort it out,wish i had some horse s*** to take to the bank and deposit that on there desk.:money:missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter0 -

When they starting communicating properly, the money was refunded in about 3 weeks
My son ran up the charges while using a number two account, but as the account was in my name, i was able to claim the repayment. My first claim under hardship, 18 months ago, was refused, but I tried again and this time was successful. Due to my being my mum's appointee, and her benefits going into my account as well as my own, it looked as though i was getting more money than I actually was, and it was this that made them decline my application in the first place. I would advise, if you're turned down under hardship, to get to find out exactly why. Despite the delay, I'm really pleased with HSBC for the speed they dealt with it in the end.0 -

I'd have taken the £70 and negotiated based on the amount of priority debt arrears(mortgage/rent, council tax, utilities).0 -
I am also in incapacity benefit due to a back problem and have been told im not fit for work (i'm only 28), I wrote to the abbey and they to said they wouldn't deal with my case until the one in court is sorted.
Are they really allowed to do this when I have two children and a very small income.

Story so far:
I've been reading the posts on here for the last 4 weeks and have been trying to process a claim with Hsbc under the hardship ruling. I printed off copies of my bank charges over the last 5 years dating back to when I was in college and didn't really know the value of money (I'm learning from my mistakes now-BIG TIME). I scanned across them all and found that I have been charged £1167 in charges over the years. I sent off the first letter detailing my request including the bit about being in hardship as I cannot cover my outgoings with my income due to a reducement in earnings. I am being left short of £150 a month but am only covering myself by borrowing off my mum who is a Widow struggling to support my siblings on her income and widows pension (major guilt). I have a bad credit rating because of my time at college when I missed payments on my credit card and loan.
I sent off the first letter and recieved the standard we believe our charges to be fair......blah blah. Can you fill in an expenditure and income form. I filled the form out with copies of my arrears letters and have heard nothing back since then. That was 3 weeks ago.
This is where I am faced with the unhelpful staff at HSBC ( the ones I have incountered so far). I called into my local branch to go through my income and expenditure there just in case they didn't recieve the one in the post. But the lady I met with in branch was rather unhelpful and kept telling me that most of my debt lay out side of HSBC bank! fair point but my bank account is with them! She told me I would have to call the helpline for further assitance. I called the helpline to be passed through to the call centre in India. Where the gentleman kept asking me to clear my overdraft of £190 as I was £3.28 overdrawn and would be hit with a further charge. He demanded a payment of £5.00 to cover it today. I don't think he really got the point that I'm in financial hardship and have no cash even on the day of payday! I then got passed through to someone who recommended that I increase my overdraft or take out a personal loan- declined for both as I have a poor credit rating and do not earn enough (V.helpful considering I told the guy all this from the start and I knew I wouldn't be approved because of my credit rating).
The ICING ON THE CAKE was when he said he would put me through to the Financial services helpline to go through my income and expenditure form. He then came back on the line to say they wouldn't accept a call from me as I had brought clothes from Primark the last 3 months totaling £30. Is it not reasonable to spend £10 a month on Knickers and basics to clothe yourself the guy ignored my response and carried on quoting nonsense to me, I'm suprised at how calm I stayed. he then went on to say he was happy to go through my income form with me. When taking my expenditure it totalled £985- which included rent, water, gas + electric, council tax, phone bill, pet insurance and my insurance and travel to work (bus), he told me that food shopping was not considered in this breakdown neither was my cat food or clothing! i'm a bit confused as I get paid £1000 a month that leaves me with £15 for cat food, clothes and a months food shop!!!! I'm not sure that really works out?
Has anyone else had this I'm not sure what to do now?
I am working hard on clearing my debts bit by bit but that money would be valuable in paying off part of my debt so that i have enough to eat and most importantly repay my poor mum! HELPRaquelle

Offered £830. Interim payment?
I took the route of claiming hardship with HSBC. I completed the form they sent and then contacted them by phone. I was contacted two days later and an offer was made over the phone! They explained that the offer of £830 is not a final payment as they would review our situation in two months time; and if our situation had not improved within that time they would review and probably make another payment of £850.
There letter confirming this arrived today; they state:"This refund will allow us to cover two months of the shortfall in your essential outgoings".
They also say that the refund agreed at this time will not affect my current claim!
I have been asked to complete and sign an acceptance form that states:"I accept a sum of £830 as outlined in this letter. I understand that any further payments made in regard to our claim will be reduced by the sum agreed in this letter."
Question: Has anyone else received or have any knowledge of this approach from HSBC and if so... what is the correct course of action?
Any advice would be gratefully received.
