Been messed around by LLoydsTSB for nearly 8 months, just over £4000 in charges over the past 6 years. Claimed financial hardship and they could not even be bothered to send me any forms to fill in to prove my hardship. Got the standard refusal letter every time I wrote to them.
Passed everything on to the FSA in August 2008, got a letter this morning saying they agreed with the bank and I am not in financial difficulty. Been overdrawn every month for ages, bank will not let me apply for an overdraft and yet they still charge me every month for going overdrawn.
I cannot understand how LLoydsTSB or the FSA can come to this decision without asking for any information with regards to ingoings and outgoings per month and what we as a family have left to live on per month
Even worse was the fact I asked them to explain why I had been charged £300 on two seperate occasions for refused direct debits, and they couldn't even give me an explanation on this.
The banks are quick enough to take our money, but when it comes to giving it back or explaining why they have taken it we don't stand a chance.0 -
it seems the banks are stalling on every one at the momonet, and the fsa/ombudsman dont seem to be helping alot in genuine hardship cases, the only thing we can keep doing is hassleing the banks like there hassle us for money.0

What you expect this for free, this is unauthorised borrowing. Where does it state you can take money from Lloyds without permission?0 -

I have gone down this route with abbey and just wondered if someone could give me some feedback re:
Lengh of time it took abbey to reply after they were in receipt of income/exp form?
They rec'd mine 2 weeks ago and I have now rec'd a letter to say there will be a delay in them dealing with it.
What other info they will be looking for apart from the above form already sent?
What criteria were they taking into account when considering the claim?
My problem is around increased borrowing to ensure that I could pay the 400.00 charges a month (at one point). This has meant a constant increase in borrowing. Although I have now fallen behind with all my credit card repayments I have managed to keep up to date with mortgage and a secured loan.
Any advice from those with exp of abbey would be very much appreciated.0 -
Due to an awful year last year-my husband and i were both off work sick for a considerable period of time,we are now having severe financial difficulties.i have currently got a bank charge claim on hold with nationwide and hubby has one with Barclays.I think we would be elligable for the financial hardship clause,How do i go about starting this process?

I can't respond on FOS's decision though one of the criteria is that you have been charged over £500 in the last 12 months.
afaik they should be asking for evidence that you are rescheduling debts and having difficulty making other payments.
On the off chance do you have a parachute account to prevent further charges? You get your wages paid into the parachute account and pay direct debits from there. You should then have no more charges on the present account. You need to make sure that when you get close to the authorised limit that you are able to cover any impending interest so as not to incur a further charge for going over the limit and another for being over the limit in that month.
The type of account you should be able to open is known as a 'basic' account. It is more or less similar to a current account but without an overdraft facility. Hopefully someone else can give further info on the pros and cons of doing this. The account should take about 5 to 7 days to open.0 -

I've just requested another copy of the financial hardship forms as I made a hash of the first lot. So I'm not so far down the road.
They may well ask for documentry evidence for rescheduling debts going be previous posts. If you've had to ask for more time to make payments and have letters to prove this for example. If you are still having to reschedule with creditors ask for it to be put in writing.
I don't know how best to deal with the credit cards though posting an soa (statement of affairs) on the dfw (debt free wannabe) board would get you a lot of good advice they are incredibly helpful over there.0 -

Where does it state that they can charge £300 for a returned direct debit, twice ?
Have you ever been unemployed and struggled to make ends meet ? it is a downward spiral that is very hard to get out of especially when a bank does not help !!!!!!!!!0 -

got the same respone from the ombudsman over my claim and same response from lloyds got nowhere.
i have a claim for 9000 plus interest and they are chasing me for the 4000 o/d but 2000 of that is default charges. sent a letter re banking code dont know if any good as they cant chase me so ive heard for a debt thats in dispute.
i dont know what to do now have to do the court route and as its a large amount i am sure they will defend it quite0
