I was in the same situation and am still receiving letters to that effect. It's taken me six months to get to the point where they still don't seem to understand the waiver correctly.
My last letter actually quoted parts of the pdf release of the waiver as well as parts of the FSA site which confirm that if you are in financial hardships the banks must still with your claim. Despite explaining this previously I didn't get anywhere but am now waiting for the final reply before I go to FOS.
If you want reassurance, call the FSA, they'll help, numbers on their site0 -
I put in a claim under Financial Hardship to Halifax in November. I recieved a reply this morning accepting i am in Financial Hardship with an offer of 210, considering my charges total over 2000 i fell this is not a reasonable offer ! I have contacted the FOB who are going to take it up.
Has anyone had any luck with th FOB ???:mad:0 -

Help, I have been trying to reclaim bank charges from Barclays since April 2008 (at the time around £1500.00 for last 2 years now in the region of £2000.00).
My husband has had to give up work due to illness and is now only receiving incapacity benefit, I work part-time, and we have been given a means tested NHS Tax Credit Exemption Certificate to pay for our prescriptions and yet Barclays are still refusing to acknowledge our case of 'financial hardship'. They say that because we are not in financial hardship with them directly (£200 overdrawn) that they are not responsible for our financial hardship in paying debts to other companies and therefore will not reveiw our request to be taken off holdand our case looked at. The Financial Services Ombudsman says that 'it would not be right to uphold our complaint re the charges soley on the grounds of our current difficulties in making ends meet.
A very clever play on the phrase of those in 'financial hardship' if you ask me! ie you need to be in severe financial hardship with Barclays NOT in day to day living!!! Anyone got any ideas or can help?

Hi, I have just begun a reclaim on an old bank account I had, with Halifax, but I currently have a current account with Natwest. Do I approach Natwest or Halifax for the financial hardship form?
I've been in touch with Natwest, but they seem to be clueless as to what I'm requesting, even going to their superiors is not finding anything out.
Any help would be great. Thanks.0 -
Hi, I was wondering if anyone can help, i have just contacted Lloyd's on the number on the letter they sent me when i originally appealed for the refund of bank charges.
I told them that i was facing financial difficulty and explained in great detail why, i had to explain this about 6 times as i got passed round so many different departments, i finally got through to someone who said they could help, he said he needed to speak to his supervisor after placing me on hold for 10 minutes he said that;
"Lloyd's TS B's terms and conditions were found to be fair by the courts so they would not be making ANY refunds"
I argued this but he stuck to his supervisors word!!
Please tell me this isn't true and what i should do next as i really feel this is unfair and am really struggling at the moment!!
Sorry for the essay but this has really annoyed me.
Thanks

Just a follow up for the above post, anyone with a Natwest account read on...
I called their customer services, who couldn't help, the two people (seperate calls) I spoke to had no idea about any of it. I called Citizens Advice, and it took them about 2 minutes to find the correct contact details for getting the FH form.
And to save a few people a phone call, send a letter to the below address simply stating that you are a natwest customer (you don't need to send account details) would like the FH form.
Easy...I hope.

I went into the university branch of Lloyds this morning, who wouldn't see me and said they could only make an appointment for the middle of next week, which would not have helped me stop the charges at all.
Went on to the Manchester city centre branch, and the woman I spoke to there, after hearing my situation and looking at my account, immediately refunded all charges and put a hold on any further fees (total of £108), and had me deposit £10 to bring my account back into the black, and all sorted. She said they could only do something like that once every 12 months, but once is enough for me for now - I do not want to let it happen again!Homosexual, Unitarian, young, British, female, disabled.
