I had a claim registered for charges with Lloyds as did my 19 year old daughter. Sitting in the queue like everyone else. However, I have no had to sign on for JSA as hubby lost his job and would like to claim under the financial hardship scheme. I have sent them a letter as has my daughter. We have mortgage arrears, utility arrears, council tax arrears (although I am applying for council tax benefit) along with personal debts. I would like to know my rights and what should happen next?

    Hi,

Did you send them a income expenditure sheet and evidence (copies of letters) of your essential arrears.

They don't have to pay out, but they will consider paying direct to your arrears, otherwise they will do things llike move you to a basic account, stop future charges and agree repayment plans on overdrafts etc.

Have you posted in the debt forums too ?

I have been reciving statutory sick pay for over 6 months and i applied to reclaim my charges using the hardship clause ( as anyone who has ever been on sick pay will tell you .... it's not a lot of money !) i contacted my bank and told them of the problems i was having ie that i was on ssp and had lost my house due to not having enough money and that i was living on my credit cards , and all Alliance and Leicester said was that they understood that i was in financial hardship , but that i will have to wait till the waiver is lifted and that they could do nothing for me ! im now on benefits and im really starting to struggle with meeting my obligations to other companies!

As far as they are conerned , im just a pain and will now not even talk with me on the phone !

If anyone has some hints on how i can get them to realise that this money will keep me from going under i would love to know !

    HELP !!!!!!!!!

Are you receiving all the benefits and help you are entitled to ?

Have you done your IE to A&L, and do you still use the account you are claiming on ?

  • I put a finacial hardship claim in on 22nd Dec they said I then had to go through their credit managemnt team they would be in touch, 2nd Jan still nothing so I rang them and asked for CMT and went through, completed the I&E and they did agree that I was in severe hardship and they would let the complaints team know, nothing happened

called several tmes every 2-3 days kept getting told that the CMT had not told them the result of the I&E but CMT told me thay had, back and forth, I have just rung again and have been told I will get call in 20 mins, we'll see

A few ^ have said halifax were quick, I wish they were for me :(

I have already done 3 expenduture forms for them ! and im getting every benefit i can ! ( i have killed a small forest filling in all the forms that the benefit lot sent me !!!!!! )

My account with A&L does still have some activity on it , in the shape of a loan direct debit , which when i tried to move to another direct debit / bank account , they made it soooooo difficult i gave up trying ! but that loan is going to be repaid next month ! and i have put enough money in that account to cover the remaining payments that are due to come out ! ( thank god for being able to reclaim my ppi money back )

After speaking to them last night i am going to try again , but this time with all of my benfit paperwork as well , as after being able to get some one to speak to me , they said thry cannot promise a pay out but it will help now that i am reciving benefits !

They have put me thru 4 months of hell , on top of my ill health , trying to sort this out .... i hope this time i find someone with a heart in the organisation :rotfl: but i might be waiting a while !

good luck to everyone still fighting !

    Hi everyone

I've been on MSE for quite a while now and I got started through getting bank charges back 2 years ago!

Now, life being life, I'm working a job where I get less pay and once again I've fallen into the vicious circle of charges. I've made a claim with Nationwide for £2500 inc interest in the case of financial hardship and I have just received their SOA form. I've filled it in and I'm sending it off tomorrow.

Can anyone advise me what might happen next?

    Thanks

    Others to come!
  • I contacted my bank because two years ago i complained about the bank charges and requested a refund, then the court case started and my case was put on hold.
I am no longer with the bank because they closed my account not long after i started the process.
Anyway i am now in financial hardship so i contacted my old bank after reading on this site about the financial hardship claise, but my bank told me that because i originally applies two years ago the financial hardship is not there fauly therefore i do not qualify. Can anyone please inform me if this is true or not?

    Many thanks

Have had claim against HBOS running since September 2008 for £4000 (approx) in charges that were incurred over a 2 year period.
Eventually escalated to FOS, under hardship, filled in income/ependiture forms.
Have been given progress details by FOS and how they were still talking with HBOS.
Offer this morning of £497.00 which only clears O/D balance on the account I moved from, lets them close account and stop any further charges.
    Have asked FOS for guidance.

  • After reading several of the comments above I consider ourselves lucky that Nat West actually took the time to listen to our situation. Drop in salary. We filled in the hardship form and spent quite a long time holding while waiting for someone to talk to us. Eventually a couple of days later someone from NatWest actually rang to double check all info we had given was correct and the very next day received an offer of £5,000 - yes a huge shock as we had only put a claim in for £3,500 (not even expecting to get that!!), so they had even bothered to add any charges since the date we applied (which must be nearly 2 years ago). Am still in shock! MOney not yet in account, but were told this could take up to 21 days. 5 days gone so far. Will let you know when it arrives. I don't know what we did to get this - we are very grateful to Martin Lewis and feel very sorry for anyone struggling out there as bank charges only make the situation 10 times worse.
  • Have claimed finacial hardship with barclays which there agree and was offered £596 as a goodwell gesture i aceppered and am now awaiting the test case
