    Natwest are being the biggest pain in the !!!! to me.

    I've rung them 4 times over the past 2 weeks, wanting to claim charges back due to financial difficulties. Every time I have called they have referred their details to their 'Debt Management' team and to call back in 48 hours. So in 48 hours I call back and low and behold, my details haven't been registered with them.

    What should I do?

    Why are you ringing them when you can write to them claiming financial hardship? They will send out an Income and Expenditure form which you send back and then the case is assessed. Please use Martin's templates and write because a telephone conversation does not have a trace as to what was actually said.

  • Hi all - i have a got a seperate thread on this but hopefulyl someone on this can help.

    We have just received a letter in which halifax acknowledge receipt of our complaint about fees (MSE hardship 1st template) and they also acknowledge that we are experiencing financial difficulties.
    They then go on to say that having reviewed our account they are satisfied the fees were correctly applied but in view of our fianancial difficulties will cancel any fees incurred in the next 3 months.

    Hi there my husband has has exactly the same response as you from the halifax. We have separate accounts and my bank paid out but Halifax seem to be extra mean at the moment. We have sent all income and expenditure lists along with all copies of court orders and bailiff actions to come but they still think we do not qualify for hardship! We have just sent a complaint form to the FOS as we have exhausted all other routes with Halifax. What i find strange is that I sent exactly the same info to my bank abbey and they settled in full. My advice to you is to put in a complaint with the fos. best of luck!

    After sending HBoS the financial statement form just before christmas I got a similar letter this morning where they accept I am 'experiencing financial difficulties'. The offer of cancelling charges for 3 months is worthless as I have already taken steps (cancelling DDs, paying things by debit card, etc) to make sure that I won't get any more.

    The £4000 of charges I am trying to reclaim (£6000 with interest) would allow me to clear two of my defaulted debts entirely (specifically debts with HBoS!) and, while I would still have the 'big debt' left to pay, I would be on much more stable ground financially. Also if it was not for the charges I am trying to reclaim I would not be in financial difficulty now...

    Have either of you (or anyone else) had any luck in pushing this forward? Or can someone suggest what the next step should be, other than going to the FOS? (I was thinking about a modified court threaten letter, changing it into a FOS threaten letter, since courts won't do anything.)

    i have now called halifax 7 times requesting a financial statement form so that I can claim under the financial hardship waiver and they never send them to me, i got a bit stroppy on the phone today and was told that they had looked at my account and have decided that i don't fit the financial hardship criteria. can they do this without me completing the form and having all my financial details?:confused:
  • I made my claim to HBOS for approx £4300 a year or so ago and after the case going on hold, I applied via the Financial hardship route. Ive been offered £1000 with my case to be reviewed depending on the outcome of the Test case to ensure I am not disadvantaged. Another result for Martin.

    I recently started reclaiming my charges under financial hardship. I sent the first letter (using one of the templates) a week ago also providing a list of my charges over the last 6 years and an insistence on a response within 14 days.
    I expected to have to chase them after reading comments on this site. I got quite excited when I got a letter in the post today from the bank (I was thinking - wow so quick!). However, when I opened it and read it I didn't know whether to laugh or cry!

    It read that they couldn't deal with my claim because the address they had for me did not match the address I had written on the top of the letter. They had 'flat 7.....' and I had written '7....'. I was told that this would need to be modified with my bank first before they dealt with the claim (which I have now done). Apart from the 'flat' bit everything was the same according to their records. Apparently this was to protect me from fraud. Never mind that no other company (including the electoral register) has a problem with just '7'! Talk about stalling!

    When I tried to phone them I just got a recorded message played over and over about the court case. Whether you ever actually get to talk to a living person is anyones guess. I didn't have the patience to find out!

    It seems as though they will use any trick in the book to delay the process. However, it has just made me even more determined to carry on. I have written a second letter now stating that I don't expect anymore delay tactics and that I will be going to the FO if I don't get a satisfactory response.

    Having found out today that the FSA waiver is being reviewed on the 26th Jan, I am now thinking that they are stalling til they know the outcome.....

    BEWARE OF STALLING PRACTICES! :mad:

    If you use the account I would guess they have a fair idea of your financial status, however I would complete your own Income Expenditure form and send it to them with details and copies of arrears letters etc explaining your financial hardship.

    Does anybody know the address to send a hardship claim letter to at Lloyds?

    I need to send this urgently. Anyone had any experiences with Lloyds paying out and how soon?

    I have sent 3 financial forms to halifax, the first one they said i wasnt in hardship but if i would like to try again to fill in another form(which they included with letter).2nd one they said i had more money coming in than i put on my form which was not the case.Now they have sent a 3rd one(which i have resent) out as they said they did not receive last one which was sent recorded delivery I've got to the point where I am fed up and think I should just wait.Anybody same problems with them ???:mad:
