    I have until the 17th february to dispute the decision by the FSA. I will ask how they met this decision with no input from me other than the letters I sent to the bank and their response.
    I will again ask for an explanation on the direct debit charges, both the £300 charges and also one for £170 and another for £150.
    It is basically these charges that have put me in the situation I am in.

    If the banks played fair then I am sure a lot of people would not be in the situation they are today. I honestly believe that the hold on cases will apply to everyone regardless of situation and the outcome of the pending court cases will favour the banks.
  • I agree with you g-unit,the more this hold on charges goes on the more it seems the courts will favour the banks.With the current credit crunch here,the last thing the goverment wants is for us to take money off the banks.So i think we're being lead on here to think we might get something,but in the end i think the goverment will put pressure on the courts to rule in favour of the bank.I think i can kiss goodbye to the £6500 those !!!!!!! thieves have taken off me,my wife and my 3 daughters!
    NOTE TO THE HALIFAX BIGWIGS:- I really hope you thieves can sleep at night with your fatcat pay rises propping up your pillows(bacause you clued on ages ago it was wrong to put your money in a bank,didn't you!!!) while we bail you out for your incompetence!!

    Can anyone point me in the right direction for a template letter as I need to contact Barclays. Apparently they are flush at the moment so I'll get in while the goings good.
    Also do I just send the letter to the local branch.

    For financial hardship there's a post on 'Annex 2' detailing all the factors that should be considered as indicative of financial hardship.

    Last time I went in and asked for appropriate forms for financial hardship made a hash of them and am trying to get them to resend them. They now insist i send a letter. So I am in the process of itemising these.

    A debt collection agency apparently needs to know how much you owe to take it to court. If the value they hold is inaccurate it apparently won't stand up in court (for example due to token payments). Is this true?
  • I don't think you are being paranoid mattavfc. Just realistic.....

    Without wishing to be negative, things are not looking good for banks at the moment (apart from for the individuals who have huge payrises!) and I think they will keep fighting as long as they can in light of this. Can you imagine them agreeing to pay consumers what must be millions of pounds (which we ARE owed!) without a fight? Even if the charges are deemed to be totally unlawful.... maybe there would be no other way for them to fight after this (I am no legal expert so wouldn't know!) but I still think they would find a way.....

    As far as I'm concerned though, this is all the more reason for us to keep fighting. I certainly intend to!

  • Am currently considering whether to claim for hardship or not. I held an account with barclays which was closed about 3 years ago and transferred into a debt management plan with cccs. i recently lost my job and stopped the DMP, intending to make full and final settlement offers to the creditors. Barclays was one of the debts i was dealing with who are now pursuing me via their inhouse debt collectors :rolleyes:. My claim is stayed pending the test case , am claiming around £1300.

    some people are saying they are getting back charges from the past year or so, but as my account has been closed for so long i do not meet this criteria.

    i have been out of work since mid sept and am a single parent on JSA, does anyone think it would be worthwhile trying to claim under the hardship rules?
