    Lloyds have told me that they are not obliged to refund any charges under the hardship claim. They are obliged to help out with overdraft charges and referred me to a debt company.Is this correct?

    They are right. No bank has to refund a single penny in charges, however, some do refund partially, some refund in full, and some suspend charges. Each individual case is different based on the circumstances.

    One request letter sent for full details of default charges since 2000.
    One letter requesting repayment of excessive amount above the £12.00 OFT guide. A&L replied by indicating MNBA' rejection of the OFT findings, however, as a 'good will' gesture in order to resolve my complaint have paid £147.00 but to my Credit card account. As there is a nil balance anyway the account will now be closed, so I should see a cheque in the post.
    Beware! the 'money back' part of the conditions only relate to makeing purchases from retail outlets that A&L have fingers in their pies. As I didn't buy from these outlets, therefore the account was really no use in that aspect.

  • i have today sent the following letter to barclays - could someone more experienced give it the once over just to be on the safe side?

    I am writing to request that you repay all the default charges that have been applied to my account during the past six years from the date of this letter. I do not believe these charges reflect the true cost to Barclays Bank of going into unauthorised overdraft.

    The charges total £1121.64 including interest and court costs. I believe I have been unlawfully deprived of the money and therefore ask that you repay me the full amount. Please find a full schedule of the charges with this document.

    I request that you deal with my case now rather than once the test case has ended as I rely on means tested benefits for my income and this has been set by the government as the minimum amount of money someone needs to live on.
    I have been unemployed and reliant on benefits since September 2008 and am a single parent. In addition to this I am also suffering extreme financial issues related to inability to pay debts to several creditors, Barclays included.
    The FSA waiver states that you should continue to deal with hardship cases.
    I look forward for a full response to this letter within 14 days.

  • I have already put a claim in but as i am with the CCCS due to lots of debt i thought id give the finacial dificulties thing a try.

    I wrote to Barclays (£3500 was my original claim) and i also enclosed my budget plan that the CCCS did for me when i joined them.

    Barclays wrote back with in 2 weeks offering me a good will gesture of £750 and the rest will be looked at upon the case being finalised.

    Im happy with this so far fingers crossed for the rest
  • An update on my claim: This week I received a bogstandard letter from NatWest turning down my hardship claim, despite me clearly stating I am in financial difficulty.

    This morning I sent all the information to the FOS. I'm not giving up without a fight!
  • Iv asked yorkshire bank about getting my charges back
    as i think i come under the financial Hardship and they have
    told me to send in a letter with a £10 Cheque is that right???

    they also said claiming is on hold and id still have to wait

    Can anybody tell me what I should do next?

    I put in a claim with Halifax, told them I was suffering financial hardship, asked for the forms, which they have now sent but I have decided not to persue that now.

    What do I do now, if I just want them to go ahead as normal?

    The letter plus £10 cheque is to obtain details of charges for the last 6 years (5 years in Scotland). If you have all your statements you don't need to send off for the details of charges.

    Reclaiming of bank charges is on hold though you should still apply so you are sooner in the 'queue'.

    Reclaiming for 'financial hardship' however is not on 'hold' though they certainly try to fob people off on that. They are obliged to consider people in financial hardship though they are not obliged to give a refund.

    If I remember correctly Yorkshire Bank is / was (?) part of HBOS. With the Bank of Scotland you can request a 'detailed financial summary' as they call it. This can be obtained from your branch. Might be worth a try if you don't have all your statements.

    Without being personal is it the info that they want that puts you off,

    from my understanding, is that the claiming is still on hold, although part of the recent case was in joe publics favour, the banks may appeal and this would go to House of Lords? it could be another 2 years before a final decision is made, then and only then would the letters of claim be looked at.
    for example - the banks are told they can only charge a maximum of £12 per incident, rather than £40, they would have to refund those who ask.

    Bear in mind the 100,000s of people that have got bank claims in, and those that are now starting to claim, it could be years down the line before you get paid out if u were entitled to a refund.

    I'm personally got a claim in with Halifax under Financial Hardship, and intend to see it through, as they took my money, yes I understand I went od etc, but does it really cost £35 a time for a letter. If you can stick with the financial hardship claim go with it, if its the form maybe CAB etc may be able to help? x
