    It is simpler to make a table with Date charge and amount and send that.

    :T Applause goes to a gentleman at NATWEST who received my latest email as regards my hardship claim. He listened was sympathetic and promised to ring me back AND DID. At 3.00pm today he was writing to me and to The Customer Response Unit after agreeing my Charges to be refunded back. When i see my REFUND i will let you know.

    It shows people if your are in serious hardship don't go down that road of thinking ah well i'll leave it. KEEP AT IT YOU MAY WIN TOO. :j

    I've been trying to reclaim charges from Halifax since before the court case - at least since late 2006. I've tried 3 times to go down the hardship route. I have several thousand pounds' worth of debt, have been made redundant and am currently temping (£6000 pa drop in salary!). Halifax rang last week - v sympathetic - went over my claim - verbally completed yet another "means test form". Said I would hear within a fortnight. Bear in mind - original claim was for £2,500.00 worth of charges - with statutory interest this amounts to over £4,000.00. They have offered to settle! Hooray! Hang on a minute - their settlement figure is £105.00. I asked if they'd missed a nought of the figure, but no. I have refused it and am going to the FOS. Can't say I'm surprised - Halifax are absolute a shower of completely inept failures!

    Without statutory interest what is the claim?
    Do you have priority debt arrears(mortgage/rent,council tax, utilities)?
    Do you have a final response from the bank?(if not you need one otherwise you may find it will be a long process with the FOS).

    I have just spoken to Barclays about a claim for financial hardship and was told they will send out a form for me to fill in about my income and outgoings to see how great my need is , when i asked how long this would take i was told 6 to 8 weeks ! why i asked ? i was told that as they are dealing with many claims at this time thing were taking a little longer ! strange as it only takes them two days to send a letter informing you of bank charges made to your account ! Is this them just stalling or is it standard procedure ?:mad:

    I've decided to try to claim my banck charges back by going the financial hardship route. My husband lost his job 3 months ago and now I am being made redundant too. We have many direct debits bouncing on our joint accound and in his account and we are about 2 months behind on mortgage repayment, gas payment and council tax so as I understand it I am classed as in financial hardship.

    My question is: it says on the aticle that you can claim back 6 years worth of charges going back to 2001, however this is not 6 years anymore, so can I only claim in the periods of 2001 to 2007 or from 2003 to 2009?

    Also do you have to put two seperate claims in for the two accounts that are getting hit by charges or can I do them both together, they are a joint account and an individual account both with Barclays?

    I will email Wendy with regards to the 6 years bit in the guide because you are right it does sound confusing. However, you can claim back from July 2001 to todays date.

    Because you have no priority debt arrears is the answer to your question. I am sorry but I don't mess around with advice if I think you aren't in hardship as defined by the FSA Waiver plus with regards to how banks and the FOS are treating hardship cases. The banks' can do nothing because you are not from fear of losing your home(mortgage/.rent arrears), losing your liberty(council tax) or losing essential services(utilities). Sorry you don't like the response but there are people in more severe financial hardship who do have the basics.

    The above should answer the question with regards to what they may do in financial hardship cases.


    And what a prat to react in such a way.....
    The prat you are referring to started out on another forum in June 2006, as someone who worked within a bank. Furthermore, this prat leaked information to the press to which he was sacked. Furthermore, this prat was out of work and survived more or less debt free and charges free on JSA and LHA. This prat has also spoken to an ombudsman on the topic of financial hardship and the way in which the FOS deals with complaints. This prat is annoyed that Martin Lewis has picked up on one aspect of the waiver and driven with it. This prat has stated this already. This prat doesn't believe in giving false hope to anyone on this forum.
    A prat I maybe but the parts you have quoted is at the heart of financial hardship.
    I would prefer to be a prat and get results quicker than having to deal with the FOS on a wing and a prayer and get nowhere fast.

    You betcha, I know the questions I want answering and I know how to get the answers. In fact, that is how I got my reputation on internet bank charges forum, by not simply going with the crowd but by going in when many bankworkers didn't go and challenge views which were simply irrational and wrong. I'm proud of the advice I give EVERY SINGLE TIME someone gets a refund.
