    European Court Of Justice.

    Can anyone interperate in easy language.

    Under Article 225 of the Consolidated Treaty Establishing the European Community appeals on judgements given by the Court of First Instance may be heard by the Court of Justice only if the appeal is on a point of law. If the appeal is admissible and well founded, the Court of Justice sets aside the judgement of the Court of First Instance. Where the state of the proceedings so permits, the Court may itself decide the case. Otherwise, the Court must remand the case to the Court of First Instance, which is bound by the decision given on appeal.

    Where are we going on this one?
    Are we talking OFT test case or your case specifically?

They are investigating a claim for hardship - but keep stating that they will not consider a claim on bank charges until such a time that the Court case with the Financial Onbudsmen is concluded. The Financial Onbudsmen believe that Barclays are attempting to deal with the matter so they keep refering me to Barclays. So I'm getting no where fast!!!!. I'll keep you posted on how I get on - I wrote a damining letter to both parties today - hopefully someone will do something about it soon!!!!.

    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

    If you are claiming on two accounts with the same bank, how much would you enclose as a statutory charge to get details of charges? £10 or £20?

    I have received a complete list of everything from my bank (natwest) and I am now going to apply with the hardship standard letter, but where it says to include a list of charges, is this me having to return a copy of all the pages they have sent me with the charges highlighted, or just the charges listed on a separate page?

    :mad::mad::mad::mad: YES I WAS SEEING RED AND SO ANNOYED BUT I KEPT AT IT.


    :T Applause goes to a gentleman at NATWEST who received my latest email as regards my hardship claim. He listened was sympathetic and promised to ring me back AND DID. At 3.00pm today he was writing to me and to The Customer Response Unit after agreeing my Charges to be refunded back. When i see my REFUND i will let you know.

    It shows people if your are in serious hardship don't go down that road of thinking ah well i'll leave it. KEEP AT IT YOU MAY WIN TOO. :j
