Bankruptcy Credit Reference File Clean Up - Discussion

Yes. Good thought.
If you want to you could dispute the entries via the CRAs.
Normally I say write the recorded delivery letters direct to the creditor as well, as that gives you the best evidence trail should you need to make a formal complaint. Plus, the CRAs often come back with "the creditor says it is correct. Sorry. Nothing more we can do".
However here, for the sake of a just this, you might think that not worth the time, money and hassle to do.
Disputing via the CRA's would easy to do, and if it doesn't get results then you've not lost anything.

I've been trying to sort mine out, my bankruptcy was May 05, so it should be totally off my report now (6yrs passed)
BUT a small debt, included in my bankruptcy was sold by barclaycard to HFO services (debt collecting scum) after my bankruptcy... HFO list a default many months beyond the bankruptcy... I called them and they agreed it was part of the bankruptcy... but the next time I checked, they'd put it to 'settled' as of July THIS year! I call them to explain their error...they say they're happy with the entry! I open an equifax dispute...
I explain to equifax that the debt was in a bankruptcy over 6yr ago, and that the "default" is months too late and the "settled" is 6+yrs too late, they update that they contacted HFO, who say the info is correct, so they close my dispute.
3 times tried, 3 times closed as "hfo say it's right"
in the USA you could sue HFO & equifax for libel... in the dumb-a55 UK... you're XXXXed0 -
Thanks Fermi, a month or so will not make a difference to me so will let them drop off on their own. Am I right in thinking they will drop of 6 years from the default date or not?
you need to get them to list it as "settled" though they may refuse until you show them a "certificate of discharge" which the court will theive £70 off you for..
I had 6+ yr old entries as default, only vanished when I got the lenders to correct as "settled"0 -
Interesting.... Expert Credit has sent a letter within 48 hours promising to sort it out, Mint have changed the detail to 'settled' on Credit Expert but not Equifax and Santander send me a patronising letter about how they're really sorry over my complaint and they'll 'look into it' within a timely manner.....
I'm assuming this is normal behaviour? lol0 -

That shouldn't be the case if the CRAs do their job properly. Defaulted accounts should be removed from your report 6 years after the default regardless of whether they have been settled or not.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

They are all showing settled or satisfied, and I have copies of a letter of confirmation from my OR stating I am discharged. It is just the default date that is wrong by a couple of weeks.:pB&SC No. 298

Ok, so Lloyds TSB have updated my files (I had 3 different accounts with them when I went bankrupt) on Equifax but have put the satisfied date as 14/10/2010 when the default date was 29/09/2009 and I was made bankrupt on 10 March 2010. (This is the same on all 3 accounts with them.)
Do I wait for the full 28 days to be up that I specified in my original letter, or do I contact them now and tell them they've still got it wrong?
Any help greatly appreciated.

Bump.
Anyone help?0 -
From what i can recall the date of interest is the default date( ie this the date 6 years on that will remove the default) the satisfied date is often when the company has updated there file and notified the CRA, it will have no effect on your credit rating or when the default gets removed.

Good Morning , Please could anyone advise on my query , I am trying to clean my husbands credit file up post bankruptcy and there are a few CCJS still showing as active , these were included in bankruptcy .
Are we able to get these updated to settled the same way we would with other creditors ? as at the moment they are all still saying active , would we just write to the court where the CCJ was issued ?
Kind regards0
