Bankruptcy Credit Reference File Clean Up - Discussion

  • Hello, it's my first post on here but been reading for a while since my husband and I declared ourselves bankrupt on 22/6/09. We are both now discharged and starting to think about cleaning our credit up.
    I've got the credit files for each of us, and there are a number of things wrong so I'll be using the letter template in the sticky post - but my question is, once I've done that, do I have to keep checking back on the credit files until they are changed, and how long should I give it?
    Also - if the debt details are wrong on both Experian and Equifax, can I just write to my creditor and ask in the one letter for them to change it with both CRAs?

    I have recently signed up for the credit expert free trial. there are a number of incorrect details on there (and other credit ref agencies also) but when i rang them to cancel they said if i send them a copy of my discharge letter they will write to the creditors on my behalf. Is this correct or are they just trying to get me to stay past the free trial?

    if you are a member of the credit reference agencies, they are actually extremely helpful as a tool to clean up all the incorrect details on your credit file(s)! and it is worth the money if you want the incorrect details cleaned up.

    The creditors respond and listen to the credit reference agencies much more so than if you contact them yourself!
    Its taken me 3 months to clean up my credit files and all 3 credit ref agencies we very helpful and played a big role in the success of it.

    Hi, I'm looking for some advice and this forum seems to have most of the answers!

    I went bankrupt 23/11/2004 and was discharged 8/6/2005. I am in the process of cleaning up my credit files and found that Experian list a British Gas debt with a start date of 24/7/2004 (before my bankruptcy), default date of 25/11/2005 (after my discharge) and current balance of £456.

    I didn't list British Gas on my Statement of Affairs (so I don't have the account number to give them anyway) and it's not named on my OR's list (although it could be under a solicitor/collection agency).

    Can I ask for the default and settlement dates to be amended accordingly and the debt marked as settled/satisfied even though I can't be sure if it was actually included in the bankruptcy? It's listed under my previous address so I don't want to contact British Gas with my new details then they start chasing me for an old debt that should have been included in the bankruptcy!

    On the other hand, I don't want to leave the default on my file until November 2011 when my other defaults will 'fall off' in November 2010. I'm hoping to apply for a small mortgage at the end of the year and don't want this to ruin my chances!

    As Far as im aware if you didnt include the debt in your statement of affairs, im afraid your stuck with the date british gas have registered.
    It would have been a different story if it was included in your statement of affairs and the default date was wrong.

    But im not 100% sure in this, id ring the official recievers office that dealt with your bankruptcy and discuss it with them.

    Should there be pre-bankruptcy data there given the time since it?

    Things not showing up that should isn't bad in itself, but it may indicate errors in what has been recorded that prevent the data showing up on your report. If you can't see the data, then you can't check to make sure dates etc are correct.

    An example of that I've seen is:

    - Bank records an account with the CRAs using an address with a small error in it.
    - Consequently that account isn't matched against you and doesn't show up when your check your report.
    - The default on that account is recorded well after the bankruptcy, but because it doesn't show up on your report you don't see that there is anything wrong to correct.
    - Years later the bank or CRA realises the mistake with the address and corrects. Suddenly the account shows up on your report with the incorrect default.
    - You may be unaware that it now shows with incorrect data until you try to apply for credit, and get rejected.

    this thread has been immense help to me over the past few months whilst cleaning up the last of my "loose ends".

    however, Barclaycard sol fin & sky card are the last bug bear.

    please can someone confirm for me that the address quoted above is the correct one for the data controller?

    as I have sent recorded letters to there, plus about 4 other addresses....

    incl.

    am just sending ICO letter, but am not even 100% sure what address to put down on the complaint form for Barclaycard sol fin & sky card. so any help/advice would be greatfully received.

    Can you tell me the earliest time you can start to do a CRF clean up. Do you wait until you are discharged or can you start will still undischarged? There is a chance we might get ED and just wanted to know if i should start now or after we have been discharged. Also does anyone know how you find out whether or not you have ED? Does the OR write to you?

    No point sorting while undischarged...leave it a month or two AFTER discharge to start the process that way it gives everything chance to update etc

    ED?...hmm never a guarantee that the OR will write or you would even be lucky to receive

    So I am going to start the big file clean up as been discharged just over 2 months now.

    My question is I had 2 loans with Black Horse, both of which have got different defaulted dates, do I need to do 2 separate letters or can I put both account numbers on the one letter and send that?
