    all UK goverment appointed agencies have to have one, Otelo were appointed by Ofcom & there MUST be a procedure to follow & lastly dont give up - thats a problem with most brits who let companies get away with murder......then we all suffer as a nation at whole, take a stance just as you have been doing

    yes I agree for ALL the T&C but subsquently YOU should have been informed of ALL detrimental changes to YOUR previous T&C, cooling off period does not exist in 3 T&C as you cannot evaluate handset/service - thats a breach of your Statutory Rights via mail order, to forsake the fact everyone has internet access or is PC literate is beyond a joke for Otelo to imply such ( more so as a goverment authorised ( Ofcom ) dept ! ) & infact all contracts are required by UK law to send you such at your request at contract commencement, upgrade or at anypoint upto 6 years where such information must be held for that time under the Data Protection Act ( 1984 & subsequent amendments )

    there is your 3 legal reasons to send to appeal

    4) OTELO is not independant of your telecom provider 3 who pay Otelo for the investigation & Otelo FAILED to apply UK consumer LAWS to protect you

    Oftel was great, Ofcon is shambolic
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    Send you complaint against Otelo service about the above three issues that Otelo never addressed them properly and failed to provide the service appointed to them by Ofcom/3's voluntary participation in the scheme

    What to do if you are still not happy
    If you have given us the opportunity to respond to your complaint about the level of service we have provided, and you’re still not happy, you can contact our Independent Assessor – Roger Jefferies.
    The Independent Assessor is appointed by our Council and has his own official terms of reference. He can deal with complaints from consumers and small businesses - but only about the level of service we provide. He cannot consider, for example, whether we were right to uphold or reject a dispute between a member and a consumer.
    The Independent Assessor will consider the information you provide and look at all our papers on the case. He will then decide whether your complaint about our service is justified. If he thinks the service we gave you was satisfactory, he will tell you why. If he thinks our service was not satisfactory, he will explain his reasons and will recommend the steps we should take to put things right.

    The Independent Assessor is Roger Jefferies.
    Roger Jefferies is a lawyer by training. He had a career in local government serving as chief executive of two London boroughs, Hounslow then Croydon. In 1993 he was appointed the Independent Housing Ombudsman. Following retirement in 2001 he was appointed as non-executive director of the Financial Ombudsman Service until February 2008. He also served for several years as an independent member of the TOSL Council, as a non-executive director of the National Clinical Assessment Authority and as chairman of the discipline committees of the South East London Health Authority. He has undertaken a number of investigations in a variety of local authorities and has run a pilot scheme as Independent Adjudicator of complaints at a London Borough.
    Each year the Independent Assessor produces an annual statement, setting out his findings and recommendations over the year. His report is published in full in our annual review each year.

    if steps are taken by Roger & Otelo refuse, you can sue Otelo with Rogers recommendations in a civil court if Otelo didnt take into consideration your Consumer Rights when reaching its conclusion & subsequently any costs you have been left out of pocket with

    I'd say you present a good legal argument, Roger being legally trained will back you.....

    oh & request copies of all your Otelo file prior to going to Roger - make sure all issues/complaints/actions were investigated proper by Otelo staff

    thought i'd revist this thread out of interest as i wondered if a decision had been made.

    sorry to hear the news rev_henry - real shame that it appears to be the end of the line.

    for my part i'm just deciding really to let my 3 deal expire or end it early - really comes down to how much i can afford. Most likely end it 2 months early in June 09.

    its a no for me, although i only got told that when i asked how things were progressing, i get the feeling they just bench rest us for 6 weeks and then give us the no and dont actually do anything about it !!

    Just to say I upgraded my 3 contract phone in October and just got my latest bill which was a shock as it was double what i normally pay from £16 to £43 aghhh!!!!!!!!!!!!! I hadnt recevied a letter or a text telling me about the per secong billing, so on wed i phoned up and argued wiith them about the breach of contract as it wasnt stated when i upgraded, they kept insisting they had sent me a letter which i asked for proof of which obviously they couldnt give i spent 45 minuites arguing to then be told someone would phone me back in withen three days untill saturday i had not heard so i phoned up again, and without arguing they offered me an extra 200 minuites(a anytime any network) and an extra 300 minuites to 3 mobiles for the same price which should mean my bill stays the same as it used to before per second billing. so it is worth trying even if you cant get out the contract the extra minuites should help with the bill.

    Just to let you know I am still awaiting an final decision on this, so don't give up...

    Plus 3 have increase some international call charges, so that may be reason to cancel too...

    Another update, got a letter from OTELO the other day saying that the case still hasn't been re-looked at yet!

    It's been 6 months since the start of this now, I have left 3 in the meantime.
  • dont hold your breath i cancelled my contract on 28 december which took an agonising 45 mins then again in january ...febuary...march then today lost the plot when they said cancellation 30 days from to day .

    Final Update

    After a long wait the ombudsman found in MY FAVOUR.

    I don't want to go into detail as I still do not want to be identified.

    Suffice to say I am not out of pocket for being forced to stay with 3.
