  • My mum has a very painful knee/thigh and the physio thinks it is caused by a trapped nerve in her back. Can anyone suggest a good single mattress that I can purchase for her online to help with her bad back/trapped nerve? Ideally the company would also take away the old mattress? :)

Could anyone tell me my rights. I bought a mattress just before Christmas off the internet. From the moment we unpacked it the house filled up with a chemical smell (we have a large 3 bed terrace), every room being affected. My wife had to sleep that night in the attic. I put up with it albeit having a strange nights sleep and was quite intoxicated the next day suffering dizzy lapses which is totally unusual for me.

We instantly got in touch with the owner who assured us that the smell was usual with new mattresses, caused by fire retardant used in their construction. I was advised to let it stand for a couple of days to let the smell dissipate and ring back if there was no change. A week later there was no change, the mattress still smelt to high heaven. We got back in touch with the owner of the firm daily after that, each time he informed us a further reason for putting up with the smell and that it would eventually go. Meanwhile my pregnant wife was being constantly affected by the sickly smell making her feel continuously nauseous. At that stage we asked for the mattress to be taken back. The owner still persisted that this could be overcome and that all mattresses had by law to be treated with fire retardant and would have this problem. I thought that this was a strange fact to be quoting from someone who specialises in the sale of mattresses as he did not even know that it was possible to get high quality mattresses (even organic ones) from a large number of small manufacturers (I had now been doing some research) that did not contain any fire retardant and still conformed to the bs kite marks.

By now I should have known I was dealing with a sub standard Internet seller but I still perservered with him. Our mattress was collected in the new year and even at this time the collection men could still smell the odour (4 weeks after delivery). I was promised a refund as soon as the mattress was returned. This obviously did not arrive.
By late Jan I contacted the firm who assured me the cheque would be in the post. Two weeks later having not recieved the cheque I contacted the owner who assured me it had been sent. He said he would put another in the post. Another two weeks passed and the cheque did not appear. (I still was being pretty patient). I got in touch again and the owner assured me it would be in the post that afternoon.
A weekor so later, now mid March, having not recieved it I rang and he said that it was on his desk and that he had forgotten to post it, could he make a bank transfer to my account. 5 working days later no funds have reached my account and I have a feeling my calls are being directed to answerphone on detection.

Could anyone, especially you Tim, tell me what I can do in this situation, have I given this internet firm enough time to sort the situation out before seeking legal advice?
People beware, dont put up with misleading information from so-called owner/experts. At the end of the day they are in business to do one thing, sell their own products to make a profit.
Also you do not need to put up with fire retardents.....do some research and look for hand made woollen ones which conform to all standards.
I just wish I could get my money back to buy one so that my wife and I can move off the floor into a real bed. Hopefully it might happen by mid May when our 4th is born

Go to moneyclaimonline (I can't remember if it's .gov or .org). Spend an hour studying the site, register, and make a claim. This replaces the old small claims court procedure. It is very easy to do and carefully designed not to be frightening or risky for people who have no idea about the law.

Normally you shouldn't take action without giving someone 2 weeks written notice but I wouldn't waste any more time in this situation. The guy is clearly acting in bad faith so I wouldn't expect the court to blame you for being precipitous. You need to act fast as there is a high risk he is going to go bust or disappear.

The cost of the action is small. You don't need to hire a lawyer. The main risk is that he disappears or goes bankrupt and never pays.

there are lots of posts on here but perhaps not specific to Tempur but other memory foam matresses. http://forums.moneysavingexpert.com/showthread.html?t=418816&highlight=foam+matress
I have one - not Tempur, wasn't as expensive, but still costly in comparison to others - but can't think of make now :o I find it extremely comfortable but I wake in the night roasting!!! If it hadn't cost so much, I would consider buying another that was a combination of sprung and memory foam as I believe they are not as heat-retaining.

If you look at the top of these threads, there's a sticky 'Which mattress?' - there may be info on there that might help you also :)

You can easily find top of the range open coil sprung mattresses for well under £150 each on line. Try to stay away from the big brand names as you won't get as much for your money. Go for 13.5 gauge open coil springs.

Many people expect a mattress to cure many problems, but all they can do is releive pressure poits that are aggravating the problem. Memory foam with pocket springs would probably be the best type of mattress for this, but the only cure would probably be a good physio.

Thanks. Yes she has had 2 physio appts. They have given her exercises to do and massaged/ultrasound on her back but she is still in a lot of pain and its very worrying... Thanks for the advice. Would you recommend any particular online retailers who would deliver and take away the old mattress?

I'm afraid that I'm not allowed to recommend anyone on here, sorry

Retailers shouldn't actually be taking away old mattresses in the same vehicle that they deliver the new one. This is down to EEC law to prevent infestation. I'm sure you wouldn't like it if you looked in the back of the delivery van and saw your brand nex expensive mattress right next to an old smelly, stained, and possibly infested mattress. The best thing to do is to contact your local council. Some will take old mattresses away free for pensioners, others charge.
