Probate Granted
Hi. Newbie here. I've been following your probate messages for many months now, while nursing a very sick parent. I'm am alone in this process as my only sibling has been estranged for 27 years. Their decision, and not even advancing years (97) and the ill health of our remaining parent prompted a response. So I am the…

Signing IHT400 form
Hi, Daft question no doubt, but does anyone know if executors who intend to have powers reserved also need to sign IHT400, or is it ok for just the main executor to sign? I've read the notes on the form itself and in the guidance doc, but I'm still unclear. Thanks

Death in service
After a bit of advice following a death about inheritance and death in service. Father in law died with no will and no real estate. There was a few small pensions and a large death in service payment. The funeral was paid for based on the payment being split equally between 4 kids. Turns out the youngest has been nominated…

Would it be reasonable for the legal costs of a caveat placed by a beneficiary to be picked up by the Estate as part of a contentious Will challenge.

Jewellery valuation for probate
Hi all I've inherited some jewellery from my mum, but need to get it valued for probate. Alot of it is of no value (though lovely) - some given to her by me for Christmas/Birthday etc. But there is her engagement ring and a couple of things she inherited from my grandmother that are probably of some value. My questions: 1.…

Signing Commercial Lease (Scotland)
Myself and my sister are both executors and beneficiaries of the residual estate of our late mother. Part of the estate is an office building my late father bought decades ago to be part of their pension. After his death, I managed the business via PoA with mother effectively a silent sole trader. I have carried on with…

Can't work out if the estate is excepted or not
I have already sent in an application for Probate based on my assumption that the estate is excepted, but woke in the middle of the night wondering if I'd misunderstood and whether I should start drafting some forms before I wait for the response from the Probate office. The estate I'm executing is as follows: - deceased…

What happens upon death of spouse?
Father in Law (92) is in hospital - he may get better, but may not.Mother in Law (88) is still coping reasonably. They still live independently in their (owned) rambling 4 bedroom house as long as 'we' do the shopping and ferrying for them. They have a will in place and we have both LPA's for them both.I *think* that the…

Letters of administration - is it needed?
My brother aged 54 died recently. He was single, never married and had no children. He didn't own property and had about £2100 in his bank account which is being used towards the funeral costs. He also had a couple of private pensions totalling about £6k. Do I need to apply for letters of administration or is this not…

IHT
When there is property held by an unmarried couple ( or siblings etc.) as Joint tenants and one dies, is the whole value of the equity/ property counted for IHT purposes? Say the deceased had life cover ( but hadn’t written it in trust ) of £350k and there was also £100k of equity in the property - would there be an IHT…

Help with simple probate…….a bit lost
Apologies in advance but I’m getting somewhat confused by online guidance. So Mum died in Feb. She had a will leaving it all to her husband, now deceased, then to my sister, also, deceased, and I with me and my sister as executors. She had no property and her estate consists of a few thousand in the bank account (already…

Changing executor on a will. Would a codicil be sufficient?
We last wrote our wills (husband and wife, mirror wills) when are offspring were children. The will named our solicitor (who wrote the will) and a sibling as executor. Now the offspring are responsible adults, we would like to make them both joint executors. We have no need to change anything else in the wills, though some…

managing estate funds before probate
I would expect this to be obvious, but it does not seem to be! This is 'second death' so all bank accounts will freeze. Still bills to pay apart from funeral expenses. Apparently executor accounts cannot be opened without a grant of probate, which as we know takes months. Some money can be released if below the threshold…

Beneficiaries of pension

Retain use of holiday flat
My partner has just been diagnosed with a very serious cancer. She has a holiday home in the UK that she would like me to continue to enjoy should she die but the benefit would transfer to her step-daughter when I die or can no longer make use of the home. We are not married or in a civil partnership. I have read of a…

IHT400 and property in will trust
Although we will be using a solicitor to submit the IHT return, I am trying to keep costs as low as possible by obtaining the values and documentation myself and draft completing the return as best I can. Something I can't find an answer to is whether I have to include the marital home. My mum was the sole owner, but an…

Applying For Probate Online - Technical Problems
I applied for Probate on Monday and the application went through fine. I paid the online fee at the end and received an email saying my payment had been successful. However, I then expected to click through to a different page on the website advising me what documents to send and with a coversheet etc and to receive maybe…

Will - original executors changed then cancelled.
After my mother-in-law died last month, I read up about probate and thought - yes, she was a widow, estate well under inheritance tax limit, next of kin are her adult son and daughter - straightforward, we can do this! We find the will, great! but immediately there is problem. So back in the 1980s she wrote the will naming…

Proof IHT has been paid to HMRC
How does someone get a copy of inheritance tax remittance for an estate (i.e. find out how much was paid) to HMRC in England and Wales? Don't have the IHT number, no probate has been applied for. Does anybody know how far back records are retained? URL appreciated.
