Final Estate Accounts - Probate / Inheritance
Does anyone know what happens when the final estate accounts are drawn up? Do the executors have to approve them / sign them off? How long do these take to get done? (using a solicitor). And what then happens to these accounts? Also, if one of the executors will have moved house by the time the accounts are done, should…

Grant of Probate revoking process?
Does anyone know what the process is when a grant of probate has been revoked? The person who is selling property to me, has had it revoked and been asked by the courts to send them a new application form, tax form and death certificate. Would this mean starting all over again?

Cheque made out to deceased family member
I was the nearest next of kin to my late mother, who passed away last autumn. My younger sister and I (her only children) took care of closing our mother's bank accounts, and settling her remaining bills, etc. There was no will and no property to take account of. Now a cheque has arrived made out to the deceased and we are…

Death Notification Service - A Review
Following the death of my mother I have just used the Death Notification Service (DNS) and thought I would share my experience. So with regard to the banks that have signed up to the DNS my mother had a current account and a savings account with HSBC; a current account with Santander and an ISA with Halifax. The funds in…

Can probate be claimed for twice?
Hi all, I was just about to order a copy of my mum's will online and found another person of the same name who died a few days after mum and whose will and probate is also registered in Winchester ( my mum's will is there despite not being from that city). Her will was overturned after death from being a Nil Band Trust…

Estate Accounts different to Grant of Probate
Hi all, I'v just found my the solicitor's Estate Accounts for the winding up of my mum's estate in 2007. Should the final total/payment/transfers/liabilities total be the same as the amount that shows on the Grant of Probate? It's £10-£12,000 different.

Intestacy problem
Hi I am looking for advice on a problem that is a real headache! My mother died 27 years ago and did not leave a will. There were six children all over 21 years of age at that time. At present there are three of the original siblings surviving. An agreement led to two family members were made administrators of the estate,…

solicitors (hidden ?) fees as executor for a will ??
My widowed mother passed away last month. The solicitor who drew up her Will is named as the Executor. Mums Will should be straight forward enough - she left everything to myself and my sister. My (adult) sister has autism and has always lived at home with my mum. She will continue to live in the family home and I will…

Avoiding care home fees.
I have always paid tax of one sort or another while also testing my entitlement to receiving a benefit. Like most folk I resent the idea that having saved to buy my own house the state should be allowed to take it away from me if I or my wife become affected with an illness that requires us to go into care especially when…

Administration of Estate Tax return
Am hopefully nearing the end of sorting out the inheritance of a late relative. The next stage is the tax return during the administration period of the estate. Will be using an accountant for this but I was just wondering how long it’s likely to take? (our solicitors have all the paperwork ready to hand over to the…

Will not stored at solicitor
I should soon be updating my will but in the meantime... My will, written a long time ago, had my brother and the solicitor who arranged it as executors. Over the years that firm of solicitors retired, it got passed to another local one, then that one went into receivership. Six months later I got told that it was now…

Transferrable IHT allowance
I'm hoping to get some advice on IHT and the rules on the transfer of nil-rate band allowance between married couples. I've looked on the .gov.uk website, but the guidance - unless I'm looking in the wrong place - is vague and confusing. The situation is that my father passed away at the end of last year, leaving…

Can I charge rent on my half of the house?
Hi, apologies if this is in the wrong place. I'll keep as brief as possible. My mum sadly passed away over 6 years ago leaving half of her property to my sister & I, with her partner owning the other half & living there still. At the time it was said that he'd never move another woman in there but 2 years later he met…

Firstly thank you for clicking on my post, and I hope someone is able to give me some guidance. To explain: I am an executor on both my late parents wills, along with my sister. Can you disinherit unknown half-siblings?
My mum keeps on at me about my will. She has made one which leaves everything to me, or if I'm gone, my son. I've made one which leaves everything to my partner, failing him our son who is a toddler, failing them both, my mum (but she is 80 so most likely will go first). My partner has left everything to me, then our son,…
