Can I charge rent on my half of the house?

Hi, apologies if this is in the wrong place. I'll keep as brief as possible. My mum sadly passed away over 6 years ago leaving half of her property to my sister & I, with her partner owning the other half & living there still. At the time it was said that he'd never move another woman in there but 2 years later he met someone. We didn't have a problem with that, it was a bit raw but people move on. He literally stopped all contact with us, stopped answering calls or texts and we didn't know why. We suspect she moved in, which again, we wouldn't have a problem with, just a bit strange maybe.
I received a letter from his solicitors on Friday making me & my sister an offer of £20k each for our share in the property, we had it valued & is worth at least £250k on the current market so £62500 each for us. I went to his house yesterday to try and discuss it in person & he wouldn't even let me in, we know his partner is living there, we aren't stupid. He said he thought we could use the money, like he's doing us a favour. He clearly wants us off the deeds for a reason.
As we own half of the property, can we charge her rent for living there?

Did the will give the partner the right to live in the house, perhaps until death? If it did were there any conditions?


If the will gave the partner no rights or if he is in breech of the conditions then you could apply to the courts for the property to be sold. Or you could always move in yourself - you would have as much right to live there as he does.


If he is acting within his rights then there is nothing you can do until he dies. Your half of the house simply isnt worth half the market value of the whole house as money due in n years time is worth less than money now. You could perhaps get it professionally valued, this would give you some negotiating power.
