Remember Newbies, in a county court there is not a precedence,
    unlike higher courts.

You can however refer to the above cases and I doubt if any judge in county court would rule against or disagree with their fellow judges

The BWLegal claim of Elliott v Loake and CPS v AJH Films
is now dead in the water

It is, as long as people know what to argue and their local court isn't Wigan!

Only the 'Appeal level' decisions are persuasive on the County courts, though.

But it's good to have an ongoing list of BW Legal's failures, so we can refer to the blogs easily.

Yes but would any judge at Wigan ignore the overwhelming
evidence and responses of other courts once shown ??
Some drivers have printed these out and given them to a judge. The judge though agreed with C-M words about the "level" of court i.e. Appeals, High Court, Court of Appeal and Supreme Court.

The judge then added in the comments that she would have needed the official transcript as well anyway.

So though BM's advice is logical, it is not the way the courts work.
Life's for living, get on with it rather than worrying about these. If they hassle, counter claim.

Do BWLegal provide an official transcript of the two cases
they refer and does not the judge have each case on record with the courts database

I, and several other like minded and generous people, fund getting transcripts when we feel they are useful.

This needs the co-operation of the defendant, as they have to order it and then get refunded once it is ready.

I try and get a cross-section of different judgments to illustrate different winning arguments, rather than a whole lot of cases, which say, show Elliott v Loake and CPM v AJH Films to be not relevant.

VCS lose in court. Keeper not liable. Elliott v Loake not relevant
Vehicle Control Services v "MadHatter" 04/07/2017

    http://parking-prankster.blogspot.co.uk/2017/07/vcs-lose-in-court-keeper-not-liable.html

    Prankster Note

BW Legal know full well that they had little hope of winning. However they were willing to play judge bingo in the hope of finding a judge not well-versed in parking law or the many decisions of their colleagues. These must now surely be few and far between.

It's great to hear that Mad Hatter won her case.

However, it's concerning to note from Pranky's blog that the judge ruled that this was private land and so bylaws were irrelevant.

Judge Bingo works across many different levels.

Where did that judge do his training?
We cannot provide you with a silver bullet to get you out of this. You have to be in for the long run, and need to involve yourself in research and work for you to get rid of this. It is not simple. We will help, but can't do it for you.

If the j8dge makes an error in law such as this, it must be brought to the attention of the DOJ. All it takes is a letter.
