Something the judge spotted: UKPPO have two signs. One for £100 penalty in small print, big red ones for £60. Felt that this may invalidate any contract as no opportunity to read the smaller £100 sign.

Good point for the other Defendants to add to their bundle for their hearings.

I asked the judge whether he was trying it as a byelaw case or a contract case. He said both. Not sure how to take that...

Can any regular find the DVLA instruction or FOI I recall, that told PPCs they cannot issue a PCN for both and must make it clear to the motorist, the legal basis of the PCN?

I didn't understand the "audience rights" which you seem to suggest was perhaps the most significant thing on the day, but I will go read up on that as I will soon be in court against the same monkeys, and if I can learn from your report then I will! Great job, onwards and upwards!

Hi all
I've read all the newbie posts and still can't find anything that is like my situation so would be grateful for any advice of which direction to take.
Received a parking fine from NCP which i appealed as a ticket was purchased. They stated that i parked for longer than i paid. It was an anpr car park and on leaving we entered the reg number and the amount came up on the screen which was paid by card. There was no option to select a length of time (i thought that was the point of ANPR car parks!)
They rejected that stating that you are prompted. Anyway i ignored their rejection and then received a couple of letters from Trace Debt Recovery which i've also ignored.
Yesterday i missed a call and searched it to find it was BW Legal and then came home to one of their £160 balance letters.
Which is the best direction to take seeing as i appealed?
I'm kicking myself for not appealing via Popla!
Any help is much appreciated.

I lost the thread I was reading. But how does the recent appeals at Salisbury by Britannia affect all this?

Not at all, as it didnt appeal the facts, just the striking out of the whole claim
