Care Parking - fine for pulling over to close boot properly.

We were just leaving a shopping complex when we noticed the car rattling quite loudly and realised the boot didn't sound latched properly. Pulled over to side of road to close the boot. We were there for 15 seconds and cctv would show the boot being closed properly and leaving.

We have received a fine from careparking . co.uk for £65 (which will increase to £90 + £140) with photos on (which shows we were there for 15 seconds!).

I know from this forum that you can ignore fines if they are not from the council but I don't know how to tell if it from the council etc.

It says things like this letter provides a case against the driver and mentions court etc. Beside the fact we weren't even parking and only pulled over for safety reasons, if it was real we would appeal.

It says it has been lawfully issued and collection will be processed under the administration of justice act 1970.

I can't find much about careparking. co.uk

Should we pay (although we would appeal anyway) or ignore?

    Likely just a PPC invoice and can safely be ignored. Full of the usual bullsh*t words and phrases intended to scare you into paying.

    administration of justice act? - They can't dispense justice. Only the state can do that.

    Apart from that, you have a right as a motorist to make your vehicle safe and they have a duty of care to allow you to be safe in their car park.

    Finally they can't enforce it anyway so you might as well send them an annonymous email telling them to go **** themselves.

    Ignore them and ignore all the silly letters full off silly empty threats about fake court action.
    They will go away eventually if they dont get a bite.

    You asked how to tell the difference between a real PCN and a fake one?

    - Simplest thing is the title, a real PCN from a Council has 'Penalty Charge Notice' whereas a private bogus PCN has 'Parking Charge Notice'

    - And a real Council one has a Council logo at the top

    - And a real Council one has reference to a Traffic Management Act or Local Authorities Act at the top (not 'the Administration of Justice Act'!)

    - And a real Council one will clearly say 'appeals/payment to be sent to the Council', whereas a fake one will give an address for the scam company.




    Do not ignore a private parking ticket - from 2013 onwards things changed in England/Wales. If yours is Parking Eye then they are suing people and so are some other PPCs.

    You must appeal and with current forum advice, you will win at popla - we win 100% of appeals in 2014.
