Am I being a unreasonable moo?

I bought a bag from ebay about 3 weeks ago - bag was lovely + feedback left on both sides.
About 10 days later a totally different bag arrives on my doorstep - no return address, no packing note. I had bought quite a lot of stuff but not this and as I was unsure who had sent it to me I put it to one side.
Had a email from the seller tonight stating that her husband had mistakenly posted another bag out to me (I HAD NOT BOUGHT THIS BAG - hadn't even bid on - in fact I knew nothing of its existance until it arrived) as he had not read the selling manager properly. Her buyer for the bag was waiting and getting very impatient, she wanted the item returned asap & expected me to pay the p&p.
I emailed back saying that if she sent me £5 by paypal I would post it back recorded delivery. She said recorded delivery only costs £2.22 and this would be all that she would send.
So I have to buy a jiffy bag big enough to put the bag in, walk the 2 miles to the post office with the bloody thing & still lose out on the cost of postage after paypal have deducted their fees for the transaction.
I emailed back & said I am perfectly willing to send it back but I am not paying for your mistake & £5 is in my opinion a reasonable amount. If you are not willing to pay £5 then you are welcome to come & collect it.
Am I being unreasonable? What would you do?

Can you not use the packaging it came in? I know it's a pain that you are going to have to take it to the post office and send back their mistake but by asking for more than the postage cost are you not making them buy back their bag?
If it had happened the other way around would you be happy to buy back your property or would you feel that you were compensating them for your mistake and their inconvenience?
At the moment I'm seeing both sides have reasonable points so have decided to sit on the fence!
How much P&P did she charge for your bag? Was it more than £2.22? If so I'd be inclined to point this out to her. She should certainly pay the same amount she charged to post to you. This would be the thing that directs the side of the fence I'd go to!0 -
seems fair enough,or the seller can send a SAE for you to use0

She charged me £4.99 for postage. It cost £1.95.
If I had bought the item & she sent the wrong one then I would send it back no probs, because it was my transaction. But this just arried with out me buying it.
The p&p cost to send it back would be £2.22, the jiffy bag would cost around 80p - what about me taking a hour out of my day to walk the 4 miles there & back to the post office? Is it really wrong to expect a little something for my time? All I want is an opportunity to prove that money doesn't buy happiness

I don't think you are being unreasonable at all. After all you have got to repackage the item, print out the label, go to PO etc etc. Time costs money and why should you be out of pocket for her mistake?
I'd stick to my guns, £5 or come and collect it.
Oh and I know you mentioned sending it recorded but please make sure you do. I can see this going pear shaped if she claims not to receive the item. Then again, whose problem is it if it gets lost? You are just returning something you didn't even ask for. Could get tricky.:heart2: Love isn't finding someone you can live with. It's finding someone you can't live without :heart2:0 -
suppose you could offer to wait in for a courier to collect with the 'seller' organising it0

She just emailed me - refuses to arrange her own courier & said that if I can't manage a 4 mile walk I must be a lazy cow!!!
I said I am perfectly able to manage a 4 mile walk thank you - but why the hell should I for someone as ungreatful as you!
She lives in Yorkshire, I live in London so she can't come & collect.
What shall I do if she refuses to pay? There was no transaction between us so can she report me to ebay?
I am very tempted to throw the !!!! bag in the bin! :mad:All I want is an opportunity to prove that money doesn't buy happiness

So... it's the sellers error, but they are expecting you to pay for it...?!
It's effectively unsolicited goods, so let the sender know that the goods are safe in your possession and will are available for collection for the next 30 days, after which you will be disposing of it as you see fit. ALternatively if the sender forwards you a pre paid envelope, you will be happy to return it to them.
Not sure of the exact T&C's of the unsolicited goods laws, but google should give you some ideas.<--- Nothing to see here - move along --->0 -
i dont think you are being unreasonable...i think £5.00 is fair or they could collect it personally....if i was the seller i would never expect someone to go out their way to post something back when i made the mistake....they are lucky you are honest as many would probably say they never recieved it and perhaps the seller will be more careful in future :rotfl:
edited to add i cant believe she said you must be a lazy cow....for that id tell her to sing for it....you no longer have it:rotfl:0 -
considering the seller charged u £4.99 postage for your bag, she must be a JOKER. stick to the £5.0
-
  I'm fuming just had another abusive email about my laziness & unwillingness to help her out as she is very hard up at the moment & obviously as I live in London I have more money than her - !!!!!!!!! London is the most expensive place in the whole country!!!
I have now told her if she wants her bag she can come and collect it within 1 week & if she is as rude to me in person as she is in her emails the bag will be inserted where the sun don't shine! If it isn't collected within a week she will find it at the local council tip:mad: :mad:All I want is an opportunity to prove that money doesn't buy happiness
