I must say I am glad that this thread keeps going - it holds a mountain of information for new people with regard to DMP's and is a great place to discuss any issues or for that matter any other queries. Thanks Rayday for sorting part 3!

Having a boring day so far at work however have tomorrow off so a nice long weekend :-)

Hi guys - wow - part 3! Can I just say you have all been a tremendous help to me since I found out about my husband's debts. My hubby has been on a DMP for a few months now.

I do have a question please if anyone can help. We have one creditor (a cc company) who are really really bad - and have referred us to their solicitor (and keep whacking the charge on the account of course!) and the solicitor sent us a letter the other day asking for copies of my husband's wage slips and details of our Child Benefit (which I receive) and Tax Credits (we get nothing - I am actually paying back 2 years overpayment!)

However in the letter the solicitor states:
"This information is required by return of post. We must advise that if it is not received then we will enter judgment against you and apply for an Attachment of Earnings which will mean us contacting your employers.

Also as you own your property we can also apply for a Charging Order."

First of all - can they apply for an AEO if we have not defaulted on the payment ruled by the Court? (It hasn't even gone to Court yet - although we have done the papers and sent them back to the cc company) Secondly if an AEO was in place - would it not be the Court that would contact the employer - rather than the solicitor?

We have written back and told the solicitor that I don't believe he has a right to the payslips as we have already given these to the CCCS and they have used this to draw up the DMP so that should be enough info for him. We have told him:-

- I receive the Child Benefit and I am in no way liable for the debt as it is all in my husband's name,

- we do not receive Tax Credits but if they want to see the deficit on that we can put that on the DMP so they get even less

- we don't believe they can apply for an AEO unless I default on the payment agreed by the Court

- if they issue an AEO I can ask for it to be deferred or whatever the term is - as it would be to the severe detriment of my husbands job.

- we have said our offer of payment is still in place and we
continue to pay this through the DMP.

-re the charging order I said this would only come into effect if my hubby defaulted on the court-ruled payment - which we have no intention of doing.

I feel they are saying some untruths in their letter or at least trying to mislead us to scare us - and if so - I want to tell them that I could report them to the OFT (don't know if it applies to solicitors though). Does anyone have a view on this?

It seems to be just yesterday that Kelly and I started this thread. Its fantastic to see its still helping people on a debt free journey that seems really scary at first. I have completed my first year of DMP this month and can honestley say its the most sensible thing I have ever done and wish I had done it years ago!!
