To find out whether your cashback provider is still trading follow this link to do a free search of companies house, the sooner you know they are going under the more you can do about it.

You need to notify companies house that the company owes you money before the company is removed from the register if you want to be able to sue them. It is free to object to the company being removed from the register.

I seethe mobile outlet is marked "proposal to strike off". Better contact them pronto. Phones2udirect is still there at the moment, although their website seems to have disappeared.

Hi Caroline,

I think you may have jumped the gun here...The company that you seem to be referring to here (company number 05530409) is based in Bristol and The Mobile Outlet that we all know is based in Bradford and trades under the name "Mobile Matters".

That said, there are 2 companies called "Mobile Matters" on the companies house site, both in or around Bradford (one set up in 2003 and another set up in 2006) - hmm...I wonder if they are related?

While it certainly pays to be careful in the current climate I would think it a little unfair for a retailer to be forced to close their doors because of misinformation posted on a popular forum where people are looking for the next big casualty...not least because that would do no favours to existing customers still awaiting cashback.

Afterall, we all know what can happen when customers get spooked - just look at Northern Rock.

Please note: This is merely intended as a general plea for reasoned calm - not an explicit vote of confidence in The Mobile Outlet as I currently have no inside knowledge about the financial stability of any UK mobile retailer to be able to make such a bold statement.

Reesit Mutton I was not suggesting anyone have a company struck off, but that people check that their cashback provider is still listed on companies house and if they are listed as proposal to strike off to apply to compnaies house to OBJECT TO THEM BEING STRUCK OFF. This means the company cannot be wound up, not that they will be struck off. If they are struck off getting any cashback you are owed will be even more difficult.

If you are reading this post please sign the petition - only 3 people so far - disgraceful - anyone with a mobile cashback deal should sign thie petition!!!

No need to fret - my comments weren't in response to your post but to Caroline's...I just wanted to be sure that companies aren't unnecessarily punished for the sins of namesakes. I guess my post could do with the insertion of the word "unintentional" in the appropriate place

I am still waiting for 2 cashbacks from this company and am not getting any replies to my emails and their help line is always engaged. I am about to post my 3rd cashback to them in the slim hope that they will keep to the terms of the contract.

Has anyone had recent success with them ?

Just received my 3rd. cashback cheque from E2Save,so so far so good,this is the 2nd time i have used them with only one little hiccup at the start of this cashback deal.

I don't believe that the mobile Network Operators have no responsibility or liability in the cashback scams. 1. The Retailers are Agents of the Network Operators and the Agency-Principal laws apply here. 2. The Network Operators despite their lame denials are fully aware of the activities of their Agents who are selling thousands of contracts daily due to the cashbacks they offer. 3. Most Network Operators like 3 have terms to cancel the contracts if tariffs are increased, a non payment of cashback is an effectual increase in tariffs.

If there is anyone ready to join me in testing in British Courts this claim that Mobile Network Operators are not liable on cashback contracts, please reply here. A class action suit will be instituted in Britain and let the courts pronounce on this cashback matter as it relates to the responsibility of the Mobile Network Providers. This will provide a judicial backing to this scam that has affected thousands of lives in the UK.

I am only half way through myself.

Roger Godsiff has claimed that the Networks are complicit in promoting Cash-Back.

He has said that Ofcom have not acted effectively, and this could be due to the fact that for Instance, Orange fund Ofcom to the tune of 2.5 million per annum, and he would assume that other Operators fund them as well, so how could they be unbiased.

The Newbury MP, where Vodafone's headquarters are has stated that he has spoken with Vodafone, who claim to not have promoted Cash-Back to retailers. He believes it is just Dodgy practice by certain Independant dealers, and a ban or legislation would be against competition.

Another MP, is stating that the whole cash-back issue, is down to the Customer and the Dealer's and the Networks should not be accountable.

He gave an example of if a car dealer went bust after you have purchased from them, should the Manufacturer be responsible.

Another MP has stated that she feels that the Voluntary Code of Conduct that is now involuntary for dealers is fair to the dealers, when it is Voluntary to the Networks.

A man from Office of Fair trading has said that they view this as seperate contracts beteween the Customer and Retailer, and customer and Network.

In May this year, there will be new EU laws relating to misleading or deceptive promotions, but Cash-Back promotions still will not be banned.
