Been an onlooker for sometime now and have finaly registered and starting to post away.

Came across this and have now sent away my first letter requesting for statements/charges from the opast 6 years :j .

I do have a few questions though.

I have 3 cards which im doing this for.

    1:Bank of Scotland Current Account
    2:Bank of Scotland Student Account
    3:Bank of Scotland/Halifax Credit card

Ive noticed that in scotland i can only issue a court claim up to £750 or £1500 for a higher case.

I take it i can Go for each card or do i need to give a total for all 3 cards?

Anyone else who has went up agains BOS with any info?
    Anything would be really appreciated.

Will let you all know how i get on as i will probably have a few questions sometime down the line.
  • Just one point in Scotland you can only go back 5 years and not 6 but as your letter has gone it will be interesting to see what they say.

See this thread regarding claiming in Scotland...

Yeah i did notice that but hey hope the still give me some info back.

Also tried a smart one whcih im sure they will have something to say about.

Just put all 3 cards on the one letter as they are with the same branch.

Should i call to see if the request has been recieved or just wait?

    Cheers

You could look at making a summary cause claim instead of using small claims. You can then claim 1500. http://www.scotcourts.gov.uk/sheriff/summary_cause/guidance_notes.asp

Putting 3 accounts in one letter is fine, as they will all be dealt with by head office anyway. It's worth phoning to check receipt. In mu opinion it is worth using a signed for postal service too so that you can get proof of delivery.

Did you send to the following address?

    BANK OF SCOTLAND
    CUSTOMER RELATIONS
    VIKING WAY
    ROSYTH EUROPARK
    ROSYTH

  • Hi there, new to the forums first off hello everyone hope everyone is well.
Ok so I was recommended to this website after complaining to friends about the amount of charges I have probably paid over the last few years. Anyway I am with Bank of Scotland and have started the first phase now of requesting a list of default charges and such like for the period dating back six years. They have agreed to this and are currently in the process of sending me six years bank statements (72 roughly i think lol). Ok so the question i have really is after recieving the statements what do i then do? I have read many posts but i am quite unsure about who to forward letter 2 and a copy of my statements (with charges highlighted) to, I have found a few address's of BoS and am unsure about whom I should send it to. I am also considering posting a copy to my local branch as well as the main one. If anyone knows or could help id be most grateful.
Also roughly how long does the process on average take in regards to recovering monies from banks with this method?
MAny thanks look forward to your replys.

i am at the same stage ,awaiting statements from them
  • Are you both claiming from Scotland or in England as their is a few differences in that you can claim back up to 6 years in England and Wales and 5 years in Scotland.

Have a check of this thread about claiming in Scotland too.

OK just thought i would let you all know,

I sent my first letter last friday regarding the Data Subject request.

    I just sent a plain old £10 Note :)

Yesterday i recieved a letter saying that they have recieved my request and as my letter stated HBOS have 40 days to fulfill this requesting and i should recieve all information requested before the 29th of Dec.

So all fingers crossed that everythign goes well from now.

And also i put all 3 of my accounts on the 1 letter

    Student account
    Current Account
    Credit Card

So seems that you can send cash and request multiple accounts on the 1 letter which i have noticed is fine from other posts.

Anyways ball has started rolling and hopefully more news soon,
