I know quite a lot about Incapacity Benefit (but not in a professional capacity), so can usually at least point people in the right direction, even if I don't know the answer.

Icemoose, you are just the person my sister needs at the moment!!!
My sis has been unemployed since july 06 after being made redundant, she has been receiving JSA, HB and CTB since then. Yesterday she got a letter from the local housing officer saying she was £500+ in arrears with her rent. She phoned the hb office and was told that they have been over paying her rent by £8 a week since September but we can't see how this is possible as she lives in a council flat, so in effect the council have been paying themselves! Also this overpayment doesn't add up to over £500, and they can't or won't account for the difference. They have told her she has to start paying £12 a week back to them or they will take her to court, she only gets £57 a week and lives on her own so there is no way she can afford £12 a week, that is just about how much money she has for shopping each week once all her bills have been paid. She's also pregnant (which is the main reason she hasn't been able to get another job) so the last thing she needs at the moment is all this stress.
Any suggestions what she should do now? She has already asked for a statement of her account so she can try to work out where these arrears have come from but the person she spoke to yesterday said they can't supply her with one and she just has to take their word for it, as 'they know how to do their own jobs' !!!!0 -

Let's see if I can be of assistance as I work for a Housing Association recovering debt and deal with benefits a lot.
1) Housing Benefit should have advised your sister in writing that there has been an overpayment on the account and the reason why and that her benefit is being reduced by £x amount each week to recover the debt. The letter also advises that she is given 28 days to appeal against this overpayment.
She needs to find out why the overpayment has occured. It can be something as simple as not responding to a letter requesting more information from her, or it could be simply a mistake. Whatever the case she needs to get to the bottom of it. She will need to go to the HB office to find out what has caused the problem, her Housing Officer would probably not know.
2) Has she ever claimed HB before? It may be that she has an overpayment from them in the past that is being recovered now as well, which they are perfectly entitled to do.
3) Regarding the arrears on the rent account, £500 is a lot to be in arrears by for a few months. Was her rent account fully up to date before she went onto benefits as this could account for some of her arrears. Also, she will need to make sure that benefits have paid in full from the correct date, for this she will probably need a rent statement. We send them out every three months and are able to provide a print of the account at any time we are asked so can trace where an account starts to go wrong. For someone to say she has to take their word for it isn't satisfactory. Speak to someone else, or make an appointment with someone at the housing office to go into it in detail.
4) Query with the Housing Officer why it has taken so long for them to notify her that she in arrears on her rent account. They are supposed to contact the tenant as soon as possible and if it has taken until the account is over £500 in arrears that suggests that they aren't keeping an eye on things.
5) With regards to court action, as of 2nd October 2006 there is a legal protocol that has to be followed for all Social Landlords to follow. Failure to do so could result in the case being thrown out of court. It may be worth googling this to see if it applies to council properties, but I think it does. There is usually a period of 3 months before we get cases into court following discovery of arrears on it (and that is finding them at one week's rent outstanding). Also a Notice Seeking Possession has to be served before court action can begin. I am presuming there has been only this phone call to your sister and that is the first she knew about it or has more been happening that you haven't said?
6) If the overpayment is legitimate and there is nothing she can do about it, as she is on a low income she can ask for the recovery rate to be reduced to a more managable amount. The £12 that she is being asked to pay now is the £8 overpayment plus £4 pw off the arrears. The £4 is also negotiable with the housing department - the minimum we accept at the moment is £2.90 p/w.
Lastly, she cannot ignore this! That level of arrears is quite serious and she needs to get to the bottom of it. Tell her to go the Council to get an appointment with HB to find out where it has gone wrong and then speak to the housing officer to let them know what is happening. She must keep them informed of what is going on - just because they are both council doesn't mean to say they talk to each other about cases.
Hope that helped and made sense (and sorry it is so long!!!). Based on what we do (or did as I am off work sick and things keep changing) it is correct to the best of my knowledge but others may make additional suggestions or correct me!

Right, there must be more than meets the eye here.
I'll bet you the arrears are either because HB are recovering an overpayment and she hasn't been paying them the difference or they are there for another reason.
It is possible to recover a HB overpayment from somebody's rent account but that debt in the rent account CANNOT be considered rent arrears. If they have sent the HB adjustment to her rent account and that is what has put her in "arrears" I'd be telling them to shove it. She would not be in arrears. But if she has been overpaid legitimately she needs to come to an agreement about repaying it and that agreement should not be more than £8.50 or £8.70 a week if she is on JSA.
You need to ask HB for a statement of reasons in writing. It is her RIGHT to have such a thing. If they say they can't do it consider approaching a solicitor. She needs to know why she has been overpaid, what period the overpayment covered, how it was calculated, if it was LA error or claimant error, why they have decided to recover it from her, why they have decided to recover it all and also if they have calculated underlying entitltment.
And ask if they have sent the adjustment to her rent account because if they have that should end any talk of rent arrears there and then.
If some idiot told me that they weren't going to give me an account statement because they knew how to do their jobs I'd have a stroke from rage.
If she is genuinely in arrears then she needs to cough up but a first step would be finding out if HB have actually caused the "arrears" from overpaying her council rent.0 -
Zingara thank you so much for your post. To the best of my knowledge she was fully paid up rent wise before she lost her job, and the only other letter she has had from them was a review form to fill in to state that her circumstances hadn't changed since she first claimed. She returned the form right away and still has the receipt to prove it. Up until the letter she received yesterday she has had absolutely no notification of any arrears and presumed everything was being covered by HB
She has claimed hb in the past, but only for a very short period of time (less than 3 months) and she notified them as soon as she returned to work, her claim hadn't even been finalised by the time she got a new job so I wouldn't have thought the overpayment came from there.
MDF_Goblin, my sis is genuinely at a loss as how this has happened, I think that the attitude she got when she phoned up yesterday was due to it being Friday afternoon and the person she was speaking to couldn't be bothered to help :mad:0 -
MDF_Goblin, Housing Benefit that has been recovered directly from the rent account would be classed as rent arrears - it would only be recovered from the rent account if it shouldn't have been paid there and if it shouldn't have been paid by HB it should have been paid by the tenant and would therefore be rent arrears. Also, they can't recover more than has been paid to the rent account. However, it is unlikely that this is the case in this instance as they are still saying they are recovering the debt at £8 per week which suggests it still exists and hasn't been offset against the rent account AND she is still in receipt of benefit which means the debt is easy to recover from.
looby75, the overpayment may well be from the earlier period. You'd be surprised at the number of people who have overpayments caused by not providing information to the town hall when they have gone back to work. It isn't always good enough to tell them that you have returned to work, they need all sorts of stuff and if it isn't provided the claim can be cancelled back and an overpayment created. Alternatively it may be the case that something in the information provided this time has contradicted something from last time and an overpayment created retrospectively.
There is no point in her getting stressed about it over the weekend. She needs to get on to HB on Monday to get it sorted and let the Housing Department know what is happening. And make a complaint about whoever said she couldn't have a statement!!!!
