    I sent my letter off before that was posted unfortunately. But I have spoken to Customer Relations to chase it up who say neither office have received it though Royal Mail say different. Don't know why I am surprised. I shall send it again, this time to Trinity Road.

    this is my first post so go easy on me if i miss out any vital info :D
    right here goes , i sent off my letter to claim back all the charges levied on my account over the last eight years, knowing that in scotland you can only claim the last 5 years :rolleyes: anyway i thought i would chance my luck,i never claimed for any intrest but after using the calculator thingy on here i wish i had done now.
    my total claim on both my current accounts came to 1950 quid, i never heard anything back for a couple of weeks and i was just about to fire off the second letter to them ,when hey presto i got a reply saying that they were "Very dissapointed" to hear that i was unhappy with all the money they had been stealing out of my account, and that thet were taking my claim seriously, but (theres always one) they would need no more than 4 weeks to "investigate" my concerns
    4 days before the time was up i got another letter saying they were still looking into the matter but they hadnt finalised all the details and that that they were giving it there full attention but it would take no more than another 4 weeks .again i waited,
    this time it took 2 weeks but they sent me an offer of 1200 quid saying it was a "gesture of goodwill". Now,i reckon 150 quid of my claim was more than 5 years ago , and knowing that you can only claim 750 quid in the scottish system at a time which means i would have to go through the process 3 times to get evry thing im owed im undecided whether to accept or to pressure them for the rest .
    any wordly advice would be appreciated

  • its up to you if you want the hassle of doing it 3 times.

    if it was me i'd take it but I think the common theme of the board is to get every last penny.
  • Obviously the decision is yours and try looking at it from the point of view its £1,200 you didn't have yesterday.

    i have another issue which i forgot to put in my first post ,as regards to future charges ,in the letter i recieved with my offer for settlement, the bank has stated that all future charges will stand,although there is no mention of future charges in the letter they want me to sign and return to accept their offer.
    if i do incurr future chances can i reclaim these?

    Yes, you can! They're still charging you unfairly and you can claim any future charges back.

    If you should claim again they are more than likely to ask you to take your business elsewhere :)
  • Hi everyone

    I am about half way through claiming back over £5000 from the Bank of Scotland.

    So far I have followed each step and used the information and template letters available on the website.

    I sent the first letter and gave the 40 days to reply.

    Got my statements which took all of the 40 days.
    Totalled up charges, sent second letter asking for charges to be returned and a response within the 14 days as stated.

    Received letter saying these were legal as stated in T&C of bank and that I could contact the Financial Ombudsman if I was not happy.

    Wrote next letter letting them know that if the charges were not returned I was willing to go to court to reclaim them with interest and court costs, this letter had a 7 day reply time.

    Well the 7 days are up today, I did receive a letter 2 days ago saying they would look into it.

    Have I given them enough time, Do I start court proceedings or give them a little more time.

    I need a little advice on the next step, how to divide up the charges to keep the claim in the small claims court.

    Please don't refer me to the CAG, I have just spent about 2 hours trying to find info on there.

    Anyone got to this stage and claiming more than the £750 limit and in Scotland, please help.
