Abbey moved my account (6 months ago) to a credit agency, as I was having difficulty paying off my overdraft, which was predominantly made up of bank charges. At present, I am still paying off the overdraft by making token payments.
I was wondering whether:
1) I can still claim back the bank charges, even though my account is with a credit agency?

my account was with NATWEST and it was with their credit mamagement dept. still claimed and won but... had to use the amount to settle what i owed them but still got £300 for myself..which i've used to pay some arrears on other stuff.

Am I able to claim any charges off accounts that have closed or in the process of being closed or in the hands of collection agencies.

Morning All,
I was with the Halifax for around 7 Years before I got in to financal difficulties and they closed my Account down, not before charging me because of unpaid DDs and returned Cheques ETC, Can I claim these charges back if some are within the 7 Years that you are able to claim up to.
I am still paying back the Halifax through a debt Company, and if I do claim are they within their rights to ask for all the Money back that I owe?

Hi all,
I'm currently waiting for my bank (hsbc) to return a list of all charges on me and my partners joint account. But i've been told by the bank that if I dont pay this months personal loan payment then my account (which is well overdrawn) will have a final demand default on it, and the account passed on to a collection agency. If this happens will I still be able to claim back my bank charges. Obviously if I can then I can pay the overdraft debt off, and also make some payments on my loan. Pleeeeease help !! thanks0 -
You can start a claim for your bank charges but be aware that any monies refunded will likely be put towards the debt.0

If you have online banking with HSBC you can view your last 6 years statement details there. If not register for it now and save some time waiting for the statements.
Before reclaiming try to come to an arrangement on the overdraft and offer some regular monthly payment if you can before reclaiming. This will help to stave off a default notice. I just advise to negotiate this before reclaiming as they may try to make things difficult for you if you are doing both at the same time.
Even if the account is closed and passed to a DCA you can still reclaim the charges and they will probably be offset against the overdraft anyway so it still benefits you.
If they do close the account you will be no worse off than you are now with regard to paying the overdraft. You have the same rights to negotiate a monthly payment based on your income and outgoings. They can demand payment in full but cannot expect it.
