    hi mate,

    mine too has been 'acknowledged' since 1st feb, and the acknowledgement receipt i got through post said they intended to defend. i think this is pretty standard stuff, as doing this gives them 28 days before they have to act. by the end of the 28 dyas they'll have either paid up or u'll be off to court. thats if they dont settle before court date!

    dont worry, either way.
  • Had letter from A/L to say they are closing my account on the 23rd March because I claimed £290 back. I did open another account in case of this so they can be as petty as they like. I would not mind paying charges if they put a fair charge on but £50 for being overdrawn for 5 days is outrageous

    Thanks to this site I am in the process of reclaiming my bank charges from A&L. I am as far as the court process and would like help please. The bank has just this morning sent me a covering letter along with a Acknowledgement of Service form to say that they have filed at Northampton Conty Court.

    Firstly, is this court usual, it's an awful long way from where I live.

    Secondly, is this the usual process, I mean, is it normal to get this letter of Acknowledgement.

    Thirdly, I did pay the £30 for it to be handled, will I actually have to go to court.

    I am very worried that they will actually make me go to court. Has anybody actually been taken as far as the court.

    Any advice would be most helpful.

    I've read elsewhere what s0ds A+L are - they probably picked one that was awkward for you.

    I went overdrawn by £100 for 2 days.
    £25 charge. They offered me half back which I took for a quiet life.
    Next month another £25 charge.

    Apparently it was £25 for paying the bill that put me over....AND £25 BECAUSE I went over!!!

    They've offered me half of this.

    I think their idea is that they impose twice as many charges but give you half back each time.

    I want to fight it this time but as I said, they are one of the most stubborn ones.

    I have just won £300 back from Alliance and Leicester after threatening court action. I have received a letter with the cheque that ends with "it is clear you don't accept the terms and conditions so we will shortly be contacting you to discuss it's future"

    However, I have a £1000 overdraft but £6000 in a savings account (only from a 0% credit card offer that closes soon). I have said I will close this account too, but they don't seem to care.

    2 questions really:
    1) if I take my £6,000 away and they close my account with £1000 overdraft, how do they expect me to pay it?
    2) what if I say I'll send them my £300 cheque back and threaten taking them to court anyway, as a bit of a threat to stop them closing my account?

    Does anybody have any views on this and if so, what do you recommend I do?

    They will give you say 30 days to settle the account.

    I don't recommend this. You cannot follow through with your threat if they have paid your claim in full.
    Does anybody have any views on this and if so, what do you recommend I do?

    OK, you're unlikely to get them to change their mind. When you reclaim charges, it's a risk the bank will close your account.

    However, when you speak to A&L, I would remind them that a complaint was recently upheld against them for closing an account as retaliation.

    The Financial Ombudsman stated the following:

    "He should not be prevented from bringing a legitimate complaint by the threat of having his account closed; nor do I consider it fair or reasonable of Alliance & Leicester to respond to his complaint about charges by closing the account. Alliance & Leicester appears to me to have used the closure of the account as a retaliatory or punitive measure".

    You can then tell them, you will be utilising their complaints procedure and if necessary taking it to the Financial Ombudsman.
