    Not recommended to contact them directly.

    Just let the case take its course - you will be sent instructions along with a copy of the defence by the court.

    But bear in mind that you will now have to pay the fee for a hearing (which gets added to your claim, and they will have to pay it if you win)

    Glad I read this. I'm still waiting for the court to get in touch following MR's defence (and part payment of my claim). Do you know how much the hearing fee is?

    I have just came of the phone to rm, i took out 2 contracts 1 in aug 2006 and 1 in dec 2006, i forgot to claim on the first contrat till the final cashback, which was july 2007, the other account iv claimed every cash back the final one being dec 2007 iv received just 1 cashback for the 2nd contract, they said today that because of problems their end i will receive all my money by the end of feb, can you believe that another 50 days. i note a lot of you guys have taken court action and i will have to do the same, when i argued with the girl on the phone she said, do you want me to cancel your contracts then you will get nothing back, who do they think they are. my blood is boiling.

    hi all, the hmcs site is down, does anybody know how long its been down for or when its likely to be up and running again , its been down since trying yesterday as far as i know, thanks

    thanks for the number quentin, but all i meant was has the site been down since the newyear as some people have said it was down till 4/1/08, or is it just a day or two maintenance

    Hi Tombola,

    As your claim is under £1,500, there is no Allocation Questionnaire fee. If it comes to a hearing, it again depends on your claim, so for claims up to £300 costs £25, £301-£500 costs £50, and over £501 to a £1k is £75. Obviously, if you win the case, the other party has to pay these fees. You can also get a refund of the hearing fees as long as you give 7 days notice in writing prior to the hearing date.

    As far as where you stand at the moment, this is the only extra it will cost you. A case of this matter is quite straightforward and simple, and should incur no further costs, assuming you have your case ready to present and ASSUMING it reaches that far.

    Hello there, just wondering if someone can help me.
    I signed up with mobile rainbow in February and had sent my claim of cash back which they received on the 19 July. I sent of all my bills and got told by mobile rainbow that I would be paid. I waited over 45 days they state in the contract, I should of heard something by September 2nd and still nothing. I rang and they told me there was a back log.
    I then sent off the second cash back claim on a Friday 21st September but was not received till Monday 24 September… and the dead line was on the Sunday 23rd September. They say I can’t have my second cash back because it’s a day late… but can I still claim against them for all the cash back money as they had already breached the contract, and still haven’t received anything.

    I have sent them an-email stating I want all the £157.50 as they have broken the contract. Just want to make sure I’m going about this right.

    Hope someone can give me a better idea
