Firstly thanks to everyone who has helped up until now, It was very much appreciated.
Other website recommended were fine but a bit confusing when they start talking about laws and things.
Until now it has been relatively easy using the information and help on this website, now the complicated part begins.
I do require a bit of help with the next stage, I don't want to leave it too long as I want to stick to the dates stated to let the bank know I mean what I say
I'm in Scotland, I want to claim over £5000, how do I do that?
From what I have read it is possible to split the £5000 into smaller amounts, do I still file this as one claim or do I have to make a claim for each amount?
I also intend to claim interest as I feel I have given the bank the ample time to settle, is the £750 limit including interest or is this added later?

Just had the famous phone call, explaining that all my charges were applied under the T&C of the account and HBOS, but they do understand in light of recent publicity my application fror the refund.
As a goodwill gesture :rotfl: they will offer me £2000.
I politely refused and said that as my case was near the expiry of MY timescales I had prepared court papers and would be filing for the full amount of £4486 plus interest totalling £5700.61.
I was then asked, so what figure am I looking for to settle - So I said the full amount of £4486 as I realise if we settle at this stage I cannot request the interest.
Another goodwill gesture then was offered of £4000. Again- I refered to the potential of moving this onto court and she said OK, £4486 it is, letter of acceptance will be with me tomorrow, and will be in my account within 7-10 days. :beer: :beer: :T :T :money:
This will be very useful for my wedding plans laters this year.

Just thought I'd give you a quick update... after requesting statements from the address in Scotland my letter also went astray. I contacted the number edinburghlass gave me and they said they would send copy statements out. They didn't so I phoned them on Monday. They then denied that I had even requested the statements or sent a cheque, so.... I got in touch with my local branch of my new bank to get a copy of the cheque that I sent, they informed me that I could pick it up, and that a department of HBOS had cashed the cheque back in December. Armed with this I marched up to the Halifax, with the copy cheque and my original letter... the manager said he doesn't deal with these queries and to contact customer relations, but when I told him customer relations had told me to bring evidence into the bank he took the copies from me and faxed them through to the appropriate department. I was then told I would have to wait 40 days again!! When I got home I decided to phone customer relations and spoke to a manager there. She was polite enough but a little offhand with me, so I made it clear that if the information was not with me by the end of the week that I would contact the information commissioner.
This morning I received two letters, the first one was a letter from Trinity road stating that my letter had been forwarded to them to deal with and that copy statements would be waiting in my local branch from 1.30pm on 1st Feb, they are giving them to the branch so that I can prove who I am, as I have changed address since I banked with them..... The other letter is from the customer relations manager with a breakdown of all charges on my account over the last 6 years which amount to £592, nearly double what I estimated!! I will still attend the branch tomorrow so that I can go through the statements myself, and once I have confirmed the charges I will send my first letter..... can't wait, I'm so giddy now!:j
Just a quick ask though... do I add the interest on now or wait until a later date?

i have until friday the 2nd of feb before my 3rd letter is due to go out to the HBOS i keep reading other peoples success stories, lots seem to mention about getting phone calls to offer them money. i have been on to the bank today and no one even went as far as an offer all they said was my claim was being dealt with and i would hear for the 16h of feb but im still going to apply me 3rd letter on friday.0

I would stick to your own time schedule. They always say 'you will hear from us within 4 weeks'.

I'm about to send off my letter, with the charges, to Halifax. Martin's blurb said send it to your 'local branch'. The branch I have the account with is in London, but I moved away from there ages ago. Do I still send it there or to my local Branch? Send it to the branch your account is with. They will forward it onto the relevent department. Make sure it is recorded/registered delivery.How many surrealists does it take to change a lightbulb?
