Hi Barclays acknowledged my court action against them, I rang MCOL last Thursday to see what date i could file judgement against them,if they didnt put in a defence. Guy from MCOL said last date falls at the weekend ,but you can file judgement after midnight Sunday 15th July ,( tonight) could Barclays still put in a defence ,after iv filed for judgement ?0
-
Yes they can and are quite likely to file a defence tomorrow and it will be accepted. I would suggest the guy from MCOL is wrong, if he said what you typed above, as generally if the date falls at the w/end you can't file for judgement until after midnight on the Monday.0

Wrote to Halifax to claim £2350ish and have recieved an offer of £1236 that has already been put into my account. I plan to ring tomorrow to ask for the full amount but what do i say, i've seen the "no predudice" but what does that mean?
Thanks Sparky xxx

I have just settled out of court. Will the court refund my costs or have I lost them0
-
You have to ask the bank for your court costs, the court won't refund.0

thanks for your reply Edinburghlass, see how it goes, no doubt they will put in a defence ,what will happen next, thank you Geoff0

Claimed: £1111.72
Received: £1003.80
Went through the process exactly as recommended on this website. Many many thanks to you guys - my kids now have a holiday to look forward to this year as booked today!!!!!
Lloyds played hardball - denying it all at first and forcing me to the small claims court. BUT £1003.80 suddenly turned up in my bank account yesterday just two weeks before court date, and with NO warning whatsoever!!
SO, why have they settled at a lower amount without my permission? Should I still go to court for the missing £107.92????0 -
i claimed back £655 from halifax in december, but had to sign an agreement form stating that the case was settled and halifax would continue to charge me if necessary. since then i have been charged £2263 i have sent three letters up to now (first one in march) the first was a refusal because i had signed the agreement form in december. i have had no response to the further two letters. i just want to know if i am entitled to claim my bank charges back for the second time even though i have had one settlement and signed the form?? has anybody else done this?0

I've done this and am at the court stage which Halifax have defended. They have used the acceptance form in their defence. When I signed acceptance it said in full and final settlement of your complaint. This was for different dates and have told them numerous times but they just ignored. I will let you know what happens. Hope it helps0 -

The Halifax are behaving badly and this should be reported to the OFT
In your case, write to Hailfax recorded delivery and state " I believe you have knowingly misled me which I will bring to the attention of the court. With regards to the charges applied to my account after I accepted your refund, I require a full breakdown of how you calculated them. If you do not give me a satisfactory answer, I will deem these charges as unlawful and commence proceedings against you."
Halifax is using underhand tactics and the OFT will frown on this.
THE MORAL:
Never sign anything that could be detremental to you later on.
If you have to sign anything, ensure you state clearly that the acceptance is only from <DATE date to>date to dateThe Winner Takes it All0
