    Hi guys, I was wondering if you could help.

    I've put in a court claim against NatWest, and have since received a letter from them offering to repay all charges. However, it does does include the interest the court would award (which is almost £1000), nor would I get back my £120 court costs.

    As such, I'd be inclined to reject the offer and continue the court action but the amount they have offered (saying this is 100% of charges) is a fair bit less than the total I calculated. I have since realised that this is because I have accidentally included the £6 (now £12) charge I pay for my Advantage Gold account.

    Is there anything I can do other than accept their offer? As the amount of my court claim is incorrect would I automatically lose?

    Any help would be hugely appreciated!

    I think to be honest I will wait it out. The time scale is going to be the same to be fair - the trouble.

  • Hi everyone need help Natwest are now defending and just had a letter from their solicitors cobbetts. Now waiting for the court to send there bit can anyone help on this bit.
    I can tell you its scary to me its £7.5k with interest and thats a lot of money to me.

    hi Gareth. Could you expand on this if u can please. Just that I have two cases going through Moneyclaim against Natwest (bank acc and credit cards). They have acknowledged and I'm waiting to see what tactics they use. Any experience you've had with them would be of interest. Cheers in advance.
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    hi Ted. I don't have an answer as I am at a similar stage to you. But, on the 'fear factor' subject... this is Martin Lewis' comment (cut from the MSE guide) on what happens if they defend.. Hopefully this may calm your nerves a little.

    I know this is the point where people get scared, which is what the banks want. If you’re one of the very few cases where the bank does enter a defence, don’t worry too much, this is pure posturing. In almost every case it's simply a way to try and make you settle, or argue that you've asked for too much (e.g. you've gone beyond six years or tried to claim compound rather than statutory interest).

    Yet, at this point you’re now in the proper court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to the court. The next stage should be a small claims hearing date, yet this virtually never happens, as the banks tend to offer a settlement at this stage. In fact, so much so judges have been very critical of banks' procedures for wasting court time.''

    My case was for a similar amount over £7000 and would have been £ 9000 with interest
    I was as worried stresed and insecure as everyone else
    I stuck to Martins templates and deadlines. I sent one additional letter offering to settle and avoid court at £7000 ie charges pointing out that court would cost them more -No repsonse-
    Filed at MCOLT. hey acknowledged in time and then it looked as if they were not going to defend Yipee At the 11th hour ie 2.0pm on the last day when I could have got judgement they lodged their defense
    about 2 weeks later I receided the solictors defense papers inone envelope and an offer for £ 6000 in another .
    Telephoning -Your choice you or may not get anywhere Duringhte process i only got frusrated with hold , call centre etc
    After the offer I rang up to negiotiate Got through 1st thing in morning Was told " Not allowed to negotiate by phone" But other sonthis site have
    I settled for the £ 6000 as I needed the money and was happy.Everyone has tomake their own decions
    My advice is to stick to the templates ,deadlines and advice on here and you will get something
    You cant lose as you will be in no worse a position than previously
    PS My daughter just went through the templates with barclaycard .Did not use MCOL or FO and she got all chages back of £ 2200

    Hi, I have sent a separate letters requesting the charges for my 2 Natwest accounts, totalling approx £7K for both accounts. I have received a reply from the bank not who have stated that the process will take approx 6-8 weeks to check my claim. This letter arrived after I had sent the court threat letter. Do I now continue with my timeline and go to the small claims court, or wait for the banks 6-8 weeks??
    Please help, this money would really help!!
