    Hi Fedup, Yan and Gills,

    Fedup, I need your Capital One account number and full name asap, via PM please.

    I am presently preparing an email for Wendy Starr and Adam Berman at Capital One to be copied to Robertson Holbrook.

    Initial response from Capital One this morning ( Wendy Starr ) is that they believe they have acted in accordance with your instructions empowering Robertson Holbrook to act on your behalf. However they are taking this matter very seriously and are currently investigating other cases currently being handled by Robertson Holbrook and will consider making a reference to the Solicitors Regulation Authority regarding this matter. Wendy also said that they will consider intervening in any indiviudal cases that I can bring to their attention ( hence the email I am preparing ).

    I am also now personally in touch with the Ministry of Justice, the OFT and the Solicitors Regulation Authority on this matter.

    Tim Russel continues to refuse to answer my calls, there is a chap called Russell White ( I suspect Russell White is actually Tim Russell ), in the Robertson Holbrook office today so feel free to hassle him as much as you like.

    I also intend to post notices on most of the Consumer reclaiming sites during the day suggesting anyone who currently has Robertson Holbrook handling claims on their behalf to send a letter to Robertson Holbrook terminating the agreement and also to write to the relevant credit card company or bank advising that the relationship with Robertson Holbrook has been terminated and any future correspondance or settlement payment should be sent only to the individual Claimant.

    I cannot tell you how blazingly mad I am that you have been treated in this manner. It is utterly disgusting that this Company and its employees are permitted to behave this way and I will not rest until the matter is satisfactorily resolved.

    Dear Wendy,

    In confirmation of my telephone conversation with you this morning and previously with Adam Berman.

    It has come to my attention via the various Consumer websites with which I am associated ( www.legalbeagles.info and www.moneysavingexpert.com ) that the claims management company, Robertson Holbrook, have been retaining settlement payments made to them by Capital One and not using those payments for settlement of Customers claims.
    I am aware of three individuals at the moment, however I am certain that this situation is likely to be considerably more widespread.

    I would appreciate any assistance that you can provide in resolving this issue, in particular for the three Customers listed below, but also to avoid similar situations developing for other Customers of Capital One in the future.

    The manner in which Robertson Holbrook are failing to respond to my and the individual Customers requests for information and payment of settlement monies together with the continual stream of lies and misinformation that Robertson Holbrook are disseminating make it perfectly obvious that they have no intention whatsoever of making settlement payments.

    It has been suggested that the three individual Customers submit LBA's to Robertson Holbrook, without further delay, so that this matter may be resolved via the Courts if necessary.

    I would also suggest that Capital One cease making any settlement payments via Robertson Holbrook for any other Customers until this matter is resolved.

    The three cases currently known are as follows :-

    1) Yan79 ( personal details provided to Cap One )
    2) Gills 1970 ( personal details provided to Cap One )
    3) fed up of rh ( I still need your personal details fed up )


    Thank you in advance for any assistance you are able to provide in resolving this matter.

    I've tried numerous times today to get through to both Tim and RH. There's no answer on either number. Do you have a number for the directors?

    Paul Thomas is director but the phone number given is the standard robertson holbrook one. Have his home address but is ex directory.

    I've been trying to call RH for at least an hour now to ask for a contact number for him but I'm not getting an answer. I'm just about to pop to the post office to send the letter. Who should I address it to?

    I've sent the letter special delivery which cost £4.95 so I've kept the receipt.
    The post office said it will be with RH by 1pm tomorrow, guaranteed!

    Gills and Fed up should ideally take the same action.

    I had a long chat this afternoon with Melloney Adams ( Head of ERC Dept ) at Capital One.
    Sadly it appears that Capital One's hands may be tied on this. There is a possibility that they may be able to do something if the particular legal status of Robertson Holbrook is such that Capital One may take some form of action by legal means. I have agreed to send copies of Robertson Holbrook accounts and other status info through to Melloney in the morning. Thanks to Esmerellda for providing this. The reason that Capital One's hands are tied is that each RH client signs a mandate which empowers RH to act on the Claimants behalf. Provided there is nothing wrong with the Company status of RH then Capital One have to carry out the Clients wishes and deal with RH in accordance with the mandate.

    On the plus side, from speaking with Melloney, I do not believe that the situation, with respect to other potential RH clients is as bad as I may have feared. I got the distinct impression that RH did not have that many claims placed with Capital One.

    That doesnt help you guys very much though.

    Please send off the LBA's as soon as you can. We will work on a county court claim POC for you and try to assist in forcing payment of this money via that route.

    I have a couple of other ideas which I will work on this evening and post up in the morning. One involves a possible solution via the Ministry of Justice, I am awaiting a call back from them in the morning.

    Sadly, I feel that county court action may end up being the only way to resolve this issue. It's sad because that was probably the main reason you went with RH in the first place so as to avoid having to get personally involved in such legal action. However, rest assured that Esmerellda and I will assist you every step of the way if we end up having to follow this path.
