It happended to me last week too. The refund was just under £100 short. So I sent another letter disagreeing with their break down, but accept that as partial payment without prejudice and ask for the reminder. I am still waiting for their response to that.
Barclays seem to have a different calculation. However, HSBC is refunding me £100 more than I asked. Different bank does different things. Very weird.Barclays: Claimed £603.25 / received £503.28 - chasing the differences (with FOS)

Hi Everyone, Right what do we think. I sent request to Halifax for £585, I received a letter today offering me £210. My gut instinct is to send the second letter requesting the full amount. Just wondering if anyone has had any dealings with Halifax, and if they have received the full amount back.
I don't want to turn down the £210 and then end up with nothing!
Any info would be much appreciated.

I have been writing to M&S Money regarding the PPI I feel they have wrongly attributed to my account. To cut a long story short I took a storecard out back in 1985, this then morphed into an &More Credit Card. I don't remember ever agreeing to take out PPI (I assume that it was an opt-out scheme), I have cancelled the insurance and tried to reclaim the costs. During the time PPI was in place I had two periods of redundancy and became self employed. If I had known about this insurance I would have claimed at the point of redundancy and then cancelled when I became self employed.
After letters to and fro to M&S who can't locate the original form they turned down my claim and referred me to the FOS. I duly filled in the form as per the MSE guide. The first response from the FOS was that they could not deal with my complaint as it had been done through an IFA. I wrote back to explain that it had not and asked them to revisit my claim. They have now written back stating that M&S Financial Services only became covered by them in April 2007 and they have no authority to deal with complaints against it about things that happened before that date.
I am a bit dumbfounded by this. M&S advised me that if I was not happy with the outcome of the complaint I could refer it to the FOS. Now the FOS say it doesn't fall within their jurisdiction.
Is there anything else I can do?0 -

I wonder if anyone can advise me. I have just started a claim through barclaycard for about £1200 of charges. I sent the letter a week ago and notice that they have already credited about £300 to my account. I am Still awaiting their letter but assume this is the difference between the £12 fee and what they actually charged.
I am determined to continue to claim the difference. However I still have a balance on this card and although this claim would reduce it significantly I am worried they may reduce my credit limit to below what remains on the card and I would be unable to pay this. This would mean I get more charges!! Also I have bank accounts and overdrafts with barclays which I'm kind of trapped with at the moment. Could this affect my other borrowing? I don't want to end up in a worse mess. I just want to get rid of my debt!!!!
Can anyone advise on whether they know of any cases where this has caused problems, or what I should do if it turns nasty.

OK - Ive got a dilemma, Ive written to all my card people - and have heard back from most of them (a few said they had sent my request to a different department cos they dont deal with reclaiming, and a few have sent the cheque back with my details...) I have started with two, just to see how i got on - and had a letter from MBNA yesterday saying they dont agree that charges are unfair,blah blah blah (im asure most of you know the one - I bet its ppretty standard!!) but as a gesture of goodwill they are sending me (in the next 10 working days!) a cheque for £308, which is the difference between my claim and the £12s...
I arng Blair Endersby who run my IVA, and they said that officially charges reclaiming IS classed as a windfall, and as such should be declared - BUT if the amount is less than £500 they arent interested in it at all, and i get to keep it all.
SO - do I continue my claim on the grounds that if it wasnt for all these charges I wouldnt be in half the amount of trouble I was anyway,and risk getting less money because I have to give BE half of it...
or do I do what Im tempted to, and say thankyou very much and pocket the cash,which I didnt have at the beginning of the month,so Im over the moon that Ive suddenly gained £308??!!!!Do not meddle in the affairs of dragons, for you are crunchy and taste good with ketchup0 -
You could write and say you accept the £308 in PART settlement for your claim, but you intend to pursue the rest of your charges with the ombudsman/court (whichever you intend to do first). But some would say you should return the cheque and refuse it to continue with your claim.
Did they state this was in full and final settlement (those exact words) in the letter?
Don't know how much this effects an IVA though, do you get to pay back through the IVA less than the full original outstanding amount for each card? It might be worth weighing up how much you would get in total from all the charges if you pursue all the cards. Would the total clear most of your debt and get you clear of the IVA sooner?
I personnally am/have pursued the full amounts on all mine but it depends how much you need the cash now really.

"nevertheless, we wish to resolve your complaint to your satisfaction. We would theresfore like to offer you a goodwill payment of £308, which will effectively reduce all your fees you have paid,to the reduced level of £12.We much reiterate that this payment is made soley as a gesture of goodwill, I have arranged for this payument to be sent to you by cheque within the next 10 working days I trust that you will find this an acceptible resolution"
they finish up by telling me that if they dont hear from me in 8 weeks they shall assume the matter is closed....
So no mention of full and final settlement - and the fact that they have come to this relatively quickly must mean they know I can go for more if I decide to - and that I am likely to win....
As for the IVA - yes, Im paying back at a lesser rate. Im not sure how much in the £ im paying ( i think its about 30p?) and im 3 years through it, so I quite possibly would be able to finish my IVA early if I was to get the full amounts on ALL my cards that I will claim for - but I havent looked into finishing early, cos I didnt know till recently that that was an option - its not come up in my calls with BE - adn im a bit scared to ask in case trhey think ive got cash stashed away that im not telling them about!!Do not meddle in the affairs of dragons, for you are crunchy and taste good with ketchup0 -
reading this and otner recaim threads, it seems £210 seems to be a magic number, especially from cap1, for their first offer..Long time away from MSE, been dealing real life stuff..
