Could anyone clarify. Is the exchange rate for the compensation calculated at the rate at the time of the flight or the current rate, and am I entitled to interest?
You are entitled to an amount of Euros. If they chose to pay you in Sterling, they should do so at current exchange rates, otherwise (assuming rates have deteriorated) you are getting less than the Euro equivalent amount specified in the Regulations.0 -

Thanks for that, I was not on this flight but we had the same thing on my claim. Just had the defence back, on first glance feeble defence.
1 Citing EC's -Lightning strike cause the engine to blow? Aircraft are designed for this. I witnessed it first hand that it was not! and proof from the AAIB that it was not lightning and a engine failure! Oh and the aircraft was still on the ground! rubber tyres and all that. Oh my god we could have aircraft blowing up all over LOL.
2. no case against them go to CAA
3. NEB's Guidelines
So work to get on with, evidence to collate, hope I can use this info though. Some solicitors are so far behind the evidence and court cases it's unbeliveable.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Sounds like you have point 1 covered for now.
Point 2 was used for a while but most airlines have dropped it since the McDonagh v Ryanair Judgment in January this year (paras 18-25 I think). Some opinion here about that case:

I have a hearing date in February for my claim against Thomas Cook. They have written to me today asking me to agree to a stay in my claim until after the Huzar Vs Jet2 decision has been appealed.
They say that apparently courts are granting stays on this basis (awaiting the appeal decision).
Any advice on whether I should agree to wait, or decline and stick to the original date?0 -
I would point out that the hearing to either grant or refuse the actual appeal is the second week in January. So if the permission to appeal is denied in January, then there would be no reason to stay your hering in February. Suggest they come bck to you after the hearing in January?If you're new. read The FAQ and Vauban's Guide

[FONT="]Well wrote to them today, flight coming out from Glasgow was delayed due to technical problems, plane eventually replaced by one sent up from Gatwick, flight from Glasgow due to take off at 09.20 that took off at 14.20.

E-mailed them with standard letter on 11/11 and got case reference, then wrote to them recorded delivery, prompted them with further e-mail 14 days later, no response.
How long is the standard wait for the fob-off letter?0 -
How do you go about replying to the defence in your statement of case?
