Yup - and tell them you will take them to court if not.0 -
I have been using Eudelay to progress a case for a delayed flight (after TC knocked me back on my own application)and TC have totally disregarded the claim, despite another member on here pm ing me to tell me they have been paid out on full from the same flight...I've tried to get hold of the member from here as he said he would give me his details to aid our case, but had no reply. Eudelay now want £80 to take the case to Court...if TC are refusing to pay now, what is the point of paying for Court action? Any advice please?

You go to Court for that very reason .... ie you/EUDelay believe you are due the money, TC won't pay so you take them to Court to prove your point. You may have been better selecting a no win no fee ie if they don't win you don't pay.0 -

We used EU delay, paid the £80 hearing fee & they paid up before it got to Court. We also got the court fee of £70 back. Of course they took their 25%. My motto a little is better than nothing. I feel sure they would not have taken your case on if they thought you wouldn't win. Good luck0 -
Has anyone claimed for this flight delay on the 4th December 2010? We were delayed 24 hours on departure and on our return date of 18th Dec. 2010 delayed 24 hours again! I have got to the stage where the CAA have returned my claim to liars Thomson but am not getting any answer. I'm a lady in my 70's and not looking forward to going down the small claims route. Scared stiff actually! Although after reading the wonderful help and advice shown here I know there is help out there.
It would be useful to know if anybody else on the above flights have claimed from Thomson Airways and been successful?

Thanks for the advice..have still got the letter from TC from on the day apologising for the delay and disruption and giving us £4 refreshment monies each.

Went to the hearing today. As expected thomas cook requested the stay. This was granted by the judge. He said he would be damned if he did and damned if he didn't.
Stayed until after the huzar appeal permission hearing when either party can request to hear the case or stay until a further date (obviously this would be after the actual hearing).
Judge did say he was very impressed with the presentation of my bundle (thanks must go to Vauban for this).
Left with huge confidence to carry on the case.
Did tell the judge about not receiving the defence until Friday 6th and he said to bring this up at future hearings.0 -

Suppose it may well turn out better for all in the long run, I can see no reason for them to be sucessful in this as i have read the wallentin case over and over and the judge Platts is just saying the same thing as in the outcome of wallentin in the chambers summing up. No legal cause for appeal I think.
Perhaps you could let me have a look at your court bundle if you would please bud, my case is for the same type of fault as yours. I already have a good idea but praise from a judge need to be taken seriously, Cheers bud.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)
