  • Firstly I must thank everyone on this forum for their help and also for the support given to all. It enables people to believe that they can indeed take on the big firms.

    After the ever so familiar story involving extraordinary circumstances and MOT's, CAA ... (you know the rest) I submitted a claim via MCOL.

    The hearing was listed for 16th December 2013.
    On 12th November we received a letter with an offer to settle 'without prejudice' for the full amount plus the initial court fee.

    We were happy to accept this and sent off a letter of acceptance and waited for the cheque to arrive.

    It arrived 29th November (after a couple of phone calls to chase it up).
    Court hearing is now cancelled and the cheque has cleared.

    If you are certain that you have a claim, then you should persevere if at all possible.

    Again, thanks to my fellow MSEers. :T

    Thought you might like to know that my claim was successful! TC admitted straight away that compensation was due and sent travel vouchers which I refused and requested cash. This was paid out last week so the whole process took about 6 weeks.

    If you were on this flight get on to TC and claim!

    I used the MSE template letter for claiming but I tweaked it a bit. I work for a law firm that deals in litigation so I threw in a few extra buzz words and phrases - whether that actually made any difference at all I don't know. I will post the letter contents on here when I get chance (I don't have them on this computer) and you can apply to your claims if necessary.

    The information on here was very helpful so thank you everyone who's contributed and shared their experiences!

    I too have received the standard reply about Thomas Cook wanting me to agree a stay in my claim which I have refused regarding the delay in the TCX315 on the 24th June 2013 Punta Cana to Manchester because of Aircraft G-OMYT TCX314 from Manchester to Punta Cana where the right hand engine blew up on take off. What I am disgusted about is point 7) of their defence which states :


    It is the Defendants case that the delay was caused by extraordinary circumstances. The delay to the flight was a result of the aircraft registration number G_OMYT pulling out of the hanger on approach to the gate and experiencing an engine failure. Engineers were dispatched in order to investigate this further and rectify the fault,,


    They have blantantly lied as this planes right hand engine had a blow out on take off.


    ,,point 8) An investigation of the technical log for aircraft registration number G_OMYT confirms that there was no previous history of defects to the engine,,


    Again a blatant lie as G-OMYT has had previous issues:


    26 Oct 2012 London - Florida diverted to Iceland overnighted probs with the engine


    9 Nov Manchester - Cuba engine problems


    10 Nov unable to take off engine problems


    17 Nov Manchester -Cancun after 75 minutes engine problem had to return to Manchester

    How are Thomas Cook getting away with this . If anybody please can bring this to the attention of the TV or Radio please show them this evidence.

    I take it you know about the 3 times in 21 days that this same plane had problems with the right hand engine in 2012? Just do not see how thomas cook can get away with it!
  • Superowls they have signed a defence for court to say that point 7 and 8 are true.


    The dailymail on the 25th June did an article on this plane with the aborted take off its all over you tube from eyewitnesses who filmed it I am just beyond words and so angry they have said it was just pulling out of the hangar . They should be sued for dishonesty aswell.

    Have you pointed this out to TC?
    If they persist you can hang 'em out to dry in the court hearing, if it goes that far. I wonder if you can include You Tube video evidence in SCC? ;)
