If this was on the new 787, it is certainly not an EC, they have had a number of problems with the toilets since bringing the aircraft into service. It has all to do with the electrics, they flush the toilets, and there are well documented cases, some with Thomson (one flight very shortly after they took delivery only got as far as Anglesey before the toilets failed) of electrical faults on this model of aircraft which I am sure you can find by googling " 787 electrical faults"0

Has anybody else had a phone call from thomson telling them that there is a cheque for £100 each compensation in the post due to the cancun to manchester delay on the 1 Nov flight no tom1950

Is there not an argument that this is therefore a manufacturing defect affecting an entire fleet? Even so, if they know the plane gives problems all the more reason to have robust back up plans to prevent delays!0 -
I have been a regular lurker on the forum preparing for a court case in December. Thanks to everyone for the amount of information on the forum as it has been an invaluable resource. I was very pleased and looking forward to the hearing and being able to refer to the recent Huzar case.
But I have received a letter from Thomson advising that as the respondent has appealed against the latest Huzar ruling they are asking the court to stay my hearing.
I will ring the court next week to find out more, but am I right in thinking that Thomson would need to pay a fee to stay the hearing? And if they do not pay the fee, as they have not done in some cases relating to the 2 year rule, the hearing will still go ahead.
Any advice about my next steps i.e. writing to the court, would be appreciated.

Cheque from Thomson for £2300 arrived in post today!
I would advise anyone who gets a call from Thomson when they make an offer to settle to push for as much as they would be happy to accept. Whilst I came off the phone knowing I probably could have got a bit more, I know that the amount I settled for is a lot of money for 2 flight delays on one package holiday for myself and my wife/children.
I still don't understand why Thomson are settling some claims that are over 2 years old and not others!
My flights were Tom 436 on 21\05\10 manc to Antalya and Tom 437 04\06\10 Antalya to manc.
Thomson used the 2 year rule, prove you were on the flight and then brake sensor maintenance and ash cloud resulting in crew out of hours defence.
They made the offer to settle a few weeks after I sent the allocation questionairre off.
Thank you to everyone on this forum who helped as without it I would probably have used a no win no fee firm!

Well, that must be very late breaking news!
I had a quick google - as you do - and the only recent reference I could find was in an update, dated 6 November, from a law firm which says:
“Absent any clear intention to appeal the decision ….”
Presumably the airlines are sharing the information among themselves!Any advice about my next steps
This is definitely one for a legal brain. It seems to be accepted that the Huzar case was very helpful but didn't set a legal precedent. It seems slightly odd that other cases cannot therefore continue. If you get a chance, the thing to do would be to object to the stay but, obviously, if that is the law, you (and the rest of us) are stuck in limbo.

Not yet - Had you sent a letter or e-mail asking for compensation or are they just sending it hoping you won't ask for more? My family (group of 7) were on the Cancun - Gatwick flight that left just after yours. Think they're trying to get away with paying out as little as possible!0
