    Hi, how long did you have to wait for your cheque from confirmation that you was getting paid out?

  • Well, Monarch have finally flummoxed me! I have just received a copy of their defence which states that they admit they are liable for the delay on my inbound flight (ZB535 Palma/Manchester 7/10/2012), yet then states that they do not accept liability for the out bound flight (ZB534 MAN/PMI 30/09/2012) and intend to rely on the defence of EC.
    Thing is, I hadn't claimed yet for the inbound delay. Just the outbound leg! I really don't know what Monarch are playing at here. They have (Surprise!) also asked for proof we were on the outbound flight that they are defending, yet not for the inbound which they accept liability for, which is odd. I shall submit my booking confirmation as proof but I expect them to stall things by insisting on boarding cards which I don't have.
    So far, I have only submitted brief details online of my claim, however neither the N180 nor the N149A ask for any full statements of my claim, which will now obviously include the inbound flight if they already accept liability. Is this something that happens later in proceedings once a date and venue has been set? or should I send a full copy of my claim and relevant documents with my N180?

    That is unbelievable!

    If they continue to insist on proof you were on the flight, make a Data Protection Act Subject Access request specifically asking if your name is on the Passenger Name Record for the flight concerned.

    I found that certainly gets their attention.

    I have another recommendation for people now, why not get a stamp in your passport at port of entry?
    The balance of probabilities will show travel to the booked destination on the booked date then.

    Good idea. If I'm ever delayed 3 hours plus in future I'm definitely going to do that, and retain the boarding passes.

    That's my stuff gone off tot he court and Monarch, needless to say they have not yet sent theirs, although monday is the last day of service.......lol

    I felt like it was a lucky dip, my local court, the county court for the area and Luton where it has been transfered to..... so have jsut sent it to all 3. As none seemed to know actually what was going on or actually where it is going to be heard and it is being combined with another case ( am guessing mine) as this is husbands witness statement......

    Now we wait for hearing date ( if one given still goes ahead) or court location change,.:j
  • First post here and I would like to thank all the regular contributors for your advice and information which I have followed in my claim against Monarch. (Yes I have waded through all the pages and the FAQ's)

    I have received a cheque from Monarch in full settlement of my claim including court fees for flight ZB 252 from London Gatwick to Alicante on 24.02.2013., so this can be added to the list. The flight was over 4 hours late leaving but made up a lot of time and arrived 3 hours and 5 minutes late.

    Monarch initially said they would defend the court case but then decided not to and sent the cheque within a few days, before I had a chance to agree the settlement!

    I thought that perhaps Monarch had seen sense and decided to deal with claims in a reasonable manner, as I was away when this happened and wasn't able to access this site, however on catching up when I returned it seems they are still fighting some cases.

    I would now be grateful for some advice regarding the other members of our group who traveled on the same flight (I agreed to be the test case for all of them) on how they should go about getting their compensation.

    Has anyone else been through this process?

    Is there a website I can check flight details from? It concerns a flight lasat year delayed outward and inward Manchester to Lanzarote but the flight number the TA gave me is showing up in the first page on this forum as a different flight?
