I believe 28 days from when the papers were served on them. And if they fail to file a defence, the judge gets to decide whether to cut them slack or move to a default judgement.
Don't get too excited - their defence will be as p--- poor as the others they've issued.
Thanks. I'm certain the defence will be poor - that's what I'm looking forward to :rotfl:
I also predict they will settle all of these out of court at some point in the near future - they have NO reasonable defence and it MUST be costing them more to try to defend.0 -
Hi Everyone,
My flight was delayed back in 2008 - got the standard two year rubbish.
Submitted small claims action (Scotland), due to be heard on Tuesday 25th June - Thomson had advised they were going to defend.
Received letter yesterday from Thomson, agreeing to settle full amount (including infant) and 8% interest, plus court fees.
Contacted Mr Moran from Thomson who has advised he will transfer money into bank account by next Friday.
Court has advised me still to attend and to ask for a continuation until money has been received.
Would like to thank all the regulars on here for all their advice and support - couldn't have done it without you.
Don't give up folks. :j0 -
Has anyone had a result with they claims for delays through Thomson
I sent them a letter back in May and have had no correspondence from them at all, I have sent them a further 2 follow up letters with no response from these either.0 -

Hi suzy
Read here also https://forums.moneysavingexpert.com/discussion/4573907 not all successes are against Thomson's but the numbers are growing everyday.
I think it is 24/1 so far.

Mr Moran dealt with our case, quite abrupt on the phone when they offered to settle 3 weeks before the court date. The defence was as usual a load of ********. Reluctant to pay up straight away their excuse being it takes 3 weeks to transfer money from their accounts department. We emailed them, we were submitting the papers back to the court at the end of the week if the money was not in our account by then. It was there the next day.
Hi romanby1 - well done! Can I ask: did your settlement include interest and court costs?0 -
Hi Everyone
Does anyone have any more detail than what's already on the thread about the case where Tommy's daughter won damages against Thomson Airlines at Truro County Court. Even the ladies surname would help. I've tried to find media references to it to use on my day in court against Thomas Cook following a 16.5 hour delay from Palma to Glasgow on 12 October 2010.
Usual excuses from TC quoting EC and Montreal Convention but I'm not buying them.
Regards

Got my offer letter from Mr Moran this morning - 4 weeks before the planned court date.
My claim was for £444 compensation plus £144 interest plus £60 costs.
They are offering £425 plus £60 (interestingly, the £425 is described as "damages" - they can't seem to get hold of the difference between compensation and damages).
Having seen that they are prepared to offer the full amount to some people, I shall be on the 'phone to them on Monday!0
