so basically they are lying suggesting they have been passed the debt by there client when they are one of the same

will wait to see if they respond to my second offer this week

I see that Tixy posted a link to the "doorstep collection" letter, a few days ago, did you send them a copy?

If not, do so today if you can and don't worry about "Power2Contact", I've had postcards from them too. They didn't turn up (not that I'd know if they had, the doorbell doesn't work! :rotfl:) and as fermi says, they are collectors, NOT bailiffs, they have no rights to enter your property, nor to demand money or goods from you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

These companies send out a barrage of letters in one go, they are mostly computer generated so they will cross in the post with anything that you have sent. Most of these letters will have a number printed in the top left/right hand corner, this is the number of the generic letter that is stored in their computer systems. Your account will show up each day on a Cougar drone's computer screen along with the action to be taken, these letters are sent in a specific sequence. Sadly, because many of their staff are not particularly well-educated, they will not notice that, say, letter 1 was only sent out yesterday and they will merrily send out letter 2, before letter 1 has reached you or before you have had time to reply. It's really nothing personal, they send out hundreds of these letters daily! :mad:

Do you know if it's true that they followed the work of B F Skinner and trained pigeons to operate their system?

I had problems with the TV licensing people not debt collectors, but I think the same solution will work.

I have no TV, and never have had in my own house, I just don't like them. However, the TV licensing people kept coming to my door, at the worst part it was about twice a month.

I found you can write telling them you are removing the common law right of access to the property, which in relpy to my first email, they replied they had noted my request - but then suggested they needed my name too. I emailed again seeking confirmation they would comply with my removal of their implied right of access without offering my name, and they replied that they would not visit, even though my name would have been helpful to them. The name I used was "The legal occupier" - which was how all their letters were addressed.

I had toyed with the idea too, of informing them of my door answering fee for people whose right of access had been removed would be the same as a TV licence, but I felt offering a price for something I was denying might be taken as revoking my removing their access - although could be taken as in offer in a contract, along the lines of parking fee companies.

If its of use to you, I could copy me emails and their replies.

I am just going through same with CFS. I am paying Capital One for a defaulted account (just raised my payments by £170 a month which means it is paid off in 20 months from now). Dispite my CCA request and request to only communicate in writing, I receive some days up to 12 calls :eek: Just sending off the harrassment letter and don't come and visit.

I was just wondering if you had any joy with them yet with a CCA?:)
